CCBC Claim received, please help me

I've received a CCBC letter dated 11th Jan from Claimant UK Parking Control Limited.

I absolutely panicked last night and after researching some stuff online, it said if I pay within 28 days and send the court evidence then the entry will be removed and it will be taken off my credit record.

I've just been on Clear Score and it's already showing on there??? Will this just be removed once the court notifies the credit reference agencies of payment?

Even if it is removed, will the credit reference agencies still be aware and my credit record still impacted?

I also spoke to a mortgage broker who has some knowledge of the impact on credit record etc and he said to pay it within the 28 days so it's taken off the register but also to fight it at the same time?

I'm thinking now that I will just fight it and then it would eliminate the risk of any impact on my credit score as I'm sure I could win following the forum.

I had 4 PCNs from these lot - 3 for parking within my own space and 1 for parking in a random space in my old building - I successfully appealed and won the 1 for parking in a random space so I know that the evidence is there to build the case and win against them?

They still have 2 more against me so I'm guessing if I don't fight it then the LBCs will be rolling in for those shortly too....

    Is this related to your earlier UKPC thread - the thread you started in March 2020?

    In that thread you never did tell us what happened after you filed a PoPLA appeal, or indeed, if you ever filed a PoPLA appeal.

    If this is a continuation of that thread, please copy your above post as a reply on to that thread and then perhaps edit your post above and this thread's title to read...

    Duplicate thread - please ignore.


    When you've done that, you will also need to tell us, or show us, what that 'CCBC letter dated 11th Jan' actually says. - but on your other thread please.

    Almost all claims here are about useless UKPC old PCNs, using DCBLegal.  You must have noticed when you read the forum before posting?

    Please read a dozen or more claim threads and the 'NEWBIES' FAQS thread (the second post, about court claims).

    It will help you see what to do.  This one is easy enough - standard UKPC meritless claim and you'll know from @Umkomaas' DCBLegal thread that they - DCBLegal/UKPC  - will discontinue later on, with no hearing needed, no risk and no CCJ, as long as you follow our advice.

    Yes, I paid the CCJ last night when I was in a state of panic.

    I have read that I can still inform the court that I have just paid it to prevent it going on my credit record, however, I plan on contesting and will claim the money back if I win???

    Ohhhhhh no.  You were mugged.  Wrong move.

    It is over.  You can't contest it.

    You would have paid nothing and had no CCJ, had you come here first.  Expensive mistake.

    It was a cinch to defend.  Such a shame.

    Then is it time for you to update that thread with the result?

    People give their time freely here to help others win their cases.
    It seems to me to be just a common courtesy to provide some feedback when their help has made a difference.
    It provides that little bit of encouragement that may be needed.
    Otherwise, how do we know what works and what doesn't?

    Hi guys - I've had a response from the court email saying I'm outside of the time to pay it

    Was I supposed to have received a 'Claim form' from the court? I haven't had that

    I've just had a 'Judgment for Claimant' form

    It says on this I have not replied to the claim form? What claim form? Was this supposed to be a document from the court? Or is that a document from the Parking firm/their solicitors???

    The email from the court says if I think a judgment has been entered incorrectly then I can apply to set the judgment aside with a N244 application notice?

    Was I supposed to have paid within 30 days of the 'claim form' or the letter I have received?

    Please help

    You should have received a N1 claim form from CCBC requiring you to file a defence; are you saying you did not receive that?  Is your address correct on the judgment you have now received?  Is your V5C up-to-date with your correct address?  What is the date of the judgment and did it give a deadline for payment?  If not it is usually one calendar month from date of issue.

    CCJ set asides are explained in the NEWBIES thread.

    Read the recent posts on the thread by @Sasanova who has also not received a claim form and is setting his CCJ aside (albeit he didn't make the mistake of paying the parking firm).  

    Your N244 application options are:

    (a) a set aside 'with consent' (£108 court fee which you won't get back and nor will you get your wasted money you wrongly paid) or

    (b) a set aside 'without consent' which costs £275 court fee and involves a hearing and you'd have to hope for a kindly Judge who may or may not order your £275 to be paid back by the Claimant.

    Yes you should have received a claim from the CCBC.  Many have recently gone astray.

    I can confirm I did NOT receive a N1 claim form. 

    Address is correct (it must have been for the judgment to have come through to my address?)

    I will read more tonight as I’m at work. 

    Could I also attempt to claim back the money I’ve paid to the parking firm? If I just state to the judge that I paid it for reassurance I could have the CCJ removed in case my defence wasn’t successful, and did this as I hadn’t received the N1 form?
