MET Parking Services, BP, Stansted Airport

Hi everyone, new poster here.

I’ve read through all the advice on here and tried to find a recent discussion about the BP at Stansted Airport but haven’t been able to find anything recent…

I received a NTK through the post, dated 30th December 2022 for an alleged contravention on the 28th. I appealed as the keeper using the advice on this forum and have today been told my appeal was unsuccessful (which I half expected).

I now have to decide whether to appeal via POPLA and would just like some advice as to whether any appeal would likely be successful. I really can’t afford £60, let alone £100, and am therefore tempted to settle it within 14 days.

However, I feel as though I’ve been wronged here. The signage is very poor and the photos they have supplied of their signs are not in situ, just screenshots that’s don’t show where they are at the location. The weather was appalling that night, no doubt making visibility even worse that it otherwise would have been at night.

Apart from the poor signage and inclement weather/darkness, are there any other grounds on which I can appeal? Reading though the forums, it would appear that MET Parking Services have got their house in order in the last couple of years and some of the loopholes are no longer available to me… I’ve uploaded screenshots of the original NTK and the appeal rejection from MET.

    There have been many threads posted here over the years which mention the airport name.

    One problem is that posters here seem to use a number of different spellings of the word Stansted.

    Try searching for Stanstead or Standstead or Standsted.
    All have been used in the last year.

    ...and change 'best match' to NEWEST!

    Easy to appeal & win without stating who was driving.  It's clearly a non-POFA NTK so that is the winning POPLA point.

    Is it a non-POFA NTK? Having checked the wording on the NTK against the legislation it would appear it’s compliant with POFA… is that not the case? Please would someone explain how?!

    Always intrigued why so many new posters can't see a clearly non-POFA NTK is non POFA!

    Ah, okay, I think I’m with you… think I just got blinded by the sheer volume of information in that legislation!

    So essentially they’ve not warned me as the keeper that have they the right to recover from me ‘so much of that amount as remains unpaid’ if not settled within 28 days?

    Yep.

    So...they don't have that right.  It's non-PoFA.

    It's not even trying to be 'PoFA', probably because it's an Airport site which is covered by byelaws.  Easy one to win!

    Airport land was my next question… as I understand it, the byelaws do not apply as the garage is accessible to the public… is that right? What constitutes airport land, is it defined somewhere?

    Copy any Airport byelaws POFA POPLA appeal (there are your 4 forum search words right there...).

    Okay, thanks. I just wanted to make sure that the BP garage is actually ‘airport land’. It’s on the outskirts of the airport but I just don’t know what constitutes airport land, presumably there’s a boundary drawn somewhere…

    Doesn't matter, honestly.  Not your burden to prove.  You can allege whatever you like at POPLA.  

    The PPC will give up when they see the usual 'kitchen sink' very long Airport POPLA appeal from a keeper they know they cannot hold liable.
