UKPC QDR Solicitor letter

Hi all,
I have recently been issued a letter by QDR for a potential county court judgement they are looking to file due to parking on a double yellow line with a disabled badge. I believe this to be extremely unfair and the signage was not clear stating that the area of land came under private. Also I displayed a valid blue badge with the right time for my blue badge holder passenger - what would the next steps be from this letter? Do I ignore? I have filed a POPLA appeal already which was unsuccessful (didn't use the template) and I have contacted my MP. After contacting my MP UKPC agreed to settle for a lower fee to which I did not respond so they after the debt collector threats they have now sent one from QDR solicitors.

I would recommend you read / follow the Newbies thread. If this is just another begging letter you can ignore it. If it formally gives you notice that it is a Letter of / Before Claim and requires you to respond within 30 days then you should continue to follow the Newbies advice in respect of submitting a SAR to the claimant and demanding a 30 day hold from the solicitors whilst your seek debt advice. This will delay them a few weeks whilst you begin to prepare to defend a county court claim.
Where was the car park? Who is the claimant? Have you taken your own photos as evidence ?2 -
What exactly do you have from QDR? Is it headed Letter Of/Before Claim (or similar)? How many days have they given you to respond? Also I displayed a valid blue badge with the right time for my blue badge holder passengerHas no applicability on double yellows on private land (check the booklet that came with the blue badge).what would the next steps be from this letter? Do I ignore? As a general rule you should never ignore a letter from a solicitor, but it does depend in what capacity they are acting. Some also act as debt collectors (QDR being one), but your answers to my questions above will help to point you in the right direction. Please be aware that QDR have been fully pursuing court cases on behalf UKPC, so, sooner or later, you may well end up having to defend a court claim. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Just to be clear: we will help you if they try a court claim. You do have to respond to a LBC.
Nothing to worry about. No CCJ is risked as long as you don't ignore a court claim, or move house without telling the scammers/their bullyboy agents.
No paying and certainly no phoning QDR!

Simply fact is, if QDR want to accept rubbish claims from UKPC, THAT IS THEIR PROBLEM
UKPC jump ship with legals, CST Law, what a disater that was, DCBL .. constant UKPC discontinuations, lots more to come in 2023
UKPC seem to like using and abusing legals, they are too scared to do it themselves
Enjoy the ride QDR, YOU WILL SOON LEARN1 -
hi all, many thanks for your help and guidance!
this is the letter i received from QDR which looks to be a 14 day warning before potentially pursuing a CCJ. I have emailed them to make a SAR request so waiting on that. Any other tips please?

I have taken photos and have the images from the UKPC claim as well to refer upon. The car was parked exactly on the arrow below with a valid blue badge0

As you know the idiots at ZZPS cannot instruct QDR.
QDR has ignored their legal requirement of PAP (Pre action protocol)
Before any court action they must send you a letter before claim giving you 30 days to respond and NOT 14 days.
And that 30 days can be extended by another 30 days for you taking debt advice. NOT 14 DAYS ?
Threatening a CCJ is total rubbish and they go on to say about a warrant of control ...... wake up QDR, it's not even been to court yet.
I would be issuing a complaint to the SRA and the CSA which they are members of because their letter is a complete fake from start from finish
A court judge would raise their eyebrows with such junk2 -
Yes that is a begging letter from QDR which can be ignored. It is designed to scare you into paying by threatening ‘bailiffs’ which the court will not sanction for the sums involved. Wait for a LBC before requesting the 30 day hold.
That sign is parallel to the road and would not be easily seen by a driver. A disabled person used to taking advantage of parking for up to 3 hours on double yellow lines might miss it and think they were alright to park. It would be useful if you could provide a close up of the sign to see what it actually says.

thanks again all, I have filed a complaint to the SRA so waiting on that. Also waiting on my MP to respond after UKPC tried to get me to pay with a smaller amount when I originally complained to my MP. Is there any other steps to complete?1

Complaint to the landowner or managing agent of the site (do some online digging).
Complain that their agent has illegally discriminated against a Blue Badge holder...and whoever contracted UKPC is jointly and severally liable.
Painting double yellows with no kerb blips, invites parking for Blue Badge holders. UKPC's obvious ignorance of the meaning and exemptions of double yellows is no excuse.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
