    You could swap "breakdown" for "vicissitude" providing you make it clear it is the vehicle that broke down and not you and then  for your witness statement you could refer to B9GF0A9E where Judge Harris said, in Jopson v Homeguard, that attending a small vicissitude is not parking.

  • I'd like to send the defence off on email today.
    I'm hoping the below reads well and I'm not missing anything.

    CCBC has acknowledged receipt of my defence in email and letter form.
    Should I be waiting on them to send me a Directions Questionnaire N180 form, or should I download, fill out out and send back asap? Any benefits/disadvantages to either?

    We have heard it said that the CCBC return unsolicited DQs as unwanted.

    Best wait for the CCBC to request one from you and then follow the guidance in that checklist you were following when you filed a defence.

    No wait until the CCBC send one. I've read here that if you submit it too soon they just discard it.

    I'm not certain but I think you can check your MCOL history and that will notify you when it's sent. Others will confirm.

    Hi All,

    I'm a bit stressed and hope you can help. 
    I've just opened a letter that came early this week and it's the 'Notice of Proposed Allocation to the Small Claims Track'.
    Also attached is the Form N180. 

    I'm told that this form needs to be completed and filed by tomorrow!

    The letter is dated 4th April but wasn't posted until the 12th of April (says on envelope) and I've only just received through the letter box perhaps Monday or Tuesday as I've been away with work.

    My questions are:
    Should/can I call the court and ask for an extension? 
    If not could I fill out the form physically or online and email it across to the relevant parties?
    Should I fill this out right away and send registered next day delivery to relevant parties?

    Yours, panicked.
