I think you should drop that counter claim, I very much doubt that the Small Claims track will agree to it unfortunately.

If you wish to continue with that you must pay the hearing fee. Email your court to point out the counterclaim is still 'live' and you want to pay the hearing fee and proceed (if you do).
But please tell us EXACTLY - word for word - how it was pleaded (by you) as most counterclaims are hopeless...and costs are not a valid counterclaim.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

- When on someone else's be it a road, a pavement, a right of way or a property there are rules. Don't assume there are none.
- "Free parking" doesn't mean free of rules. Check the rules and if you don't like them, go elsewhere
