I think you should drop that counter claim, I very much doubt that the Small Claims track will agree to it unfortunately.

BBC WatchDog “if you are struggling with an unfair parking charge do get in touch”

Please email your PCN story to watchdog@bbc.co.uk they want to hear about it.
Please then tell us here that you have done so.

    Well done!

    ANOTHER ONE BITES THE DUST!

Wait, they discontinued but you have a live counterclaim?

If you wish to continue with that you must pay the hearing fee.  Email your court to point out the counterclaim is still 'live' and you want to pay the hearing fee and proceed (if you do).

But please tell us EXACTLY - word for word - how it was pleaded (by you) as most counterclaims are hopeless...and costs are not a valid counterclaim.
    I agree. £35 down the pan. 🤦‍♂️
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

  • I agree with the others to drop your counterclaim.

You are already the winner, BWLegal and Britannia chickened out

Thank you very much for all your advices and support throughout! I wouldn't have done it without you!

I will work out how to drop the counterclaim and will also write to BBC WatchDog about my experience as suggested by Mouse007.

Wishing you all a good year and fingers crossed the new CoP is soon in place.

    Good stuff.

See you shortly, for the final Public Consultation on the banning of the DRA 'fee' and the implementation of lower, less enriching parking charges.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Courts are procedural and run on forms. This is the one you need
