    If it is the claimant you are proposing to write to with your questions don’t hold your breath. You should focus on getting your defence written. Use any additional information from your research in your future WS

  • Hi I know, but if they don’t answer I can at least say I asked. 

     I will establish that there were problems with this car parks, then put the onus on them to prove the machines were not faulty on the day the car was there. 

    Ask for all machine date for that day. 

    But I will need a brief holding defence in meantime.  Any ideas?

    Its irrelevant that you asked in a court defence.
    You dont do a holding defence there is no such thing

    The only thing you ask Armtrac for is a Subject Access Request (SAR) - do that now

    Do not expect to receive a reply before you have to file your defence, do not waste your time asking them anything else.

    You need to focus on a few well crafted paragraphs to insert at number 3 in the template defence. Start with their Particulars of Claim, what are they alleging the driver did wrong?

    Later you will need to prepare a Witness Statement, that is when the information in the SAR may be helpful. In the meantime google Armtrac, the online reviews and news stories will tell you how bad they are.

  • Hi Mouse007,

    I sent SAR 15 days ago, I will compile a defence with the information I have now.  I will not put everything in yet, I will save that for my witness statement.
     Sorry to ask but where’s the template defence on here, I’ve looked but brain a bit slow just recovering from bout of pneumonia.

    Alternatively, the template defence thread is one of the first half a dozen or so threads pinned at the top of the Parking Board. Easily recognisable - the first two words of the thread title are Template defence...
