PPM and BW Legal appealing after I beat them twice

@Coupon-mad I don't think they can appeal an appeal. I believe this was a final hearing and that's the end of that.
What they can do, however, is as their is one more further ticket, they can issue another claim, which they had already sent a threat letter for. I showed this to the judge at the appeal saying they were preparing ANOTHER claim, hoping that the judge would then issue the CRO as they've already had two claims dismissed and now appeal dismissed also.
Yes, transcript for second whole hearing and transcript for second transcript of judgement I got free of charge. Ideally I should have got transcript for judgement of first hearing but time and money being an issue but with the costs I won yesterday, I might apply for it when I apply for this one. However, again, might not be as useful as the judge yesterday said previous DJs decisions were not binding on him.
I think ppm/BW will have it transcribed because their barrister was hurriedly transcribing the judgement in his own book at the time and also when the judge mentioned that he would give me permission to obtain the transcript of the judgement, their barrister asked for the same permission and the judge allowed it.
Important to mention also that I had a whole other wealth of argument/evidence but the judge wouldn't allow me to explain everything, he actually stopped me and told me to quit while I was ahead! He said he acknowledged there was more but that his decision would be based on the fact of ppm essentially removing a right given to leaseholders by implementing their scheme.0 -
Oh no they can appeal an appeal if they have grounds. This is how cases get to the CoA. This is how the Beavis case got all the way up to the Supreme Court.
I doubt they will. Very expensive. And risky.
By the sound of it there wouldn't be grounds for them to appeal, as long as the Judge's rationale is clear and he hasn't made an error of law.
Your transcripts are going to be very important.
By the way have I told you about this?
If you could reply to this Inquiry that would be superb. ...only TWO WEEKS left to do this relevant Inquiry linked & discussed here:
Really relevant because the reason there are delays in the work of the county court is because up to a THIRD of all small claims are parking. Shocking how they are using and clogging up the courts.
Your paperwork will be great evidence. A case with real delays. This is about showing how parking firms abuse the court service.
There needs to be an ADR buffer pre-action, and the "debt claims" pre-action protocol. Asking for people's income on a DEBTOR reply form is utterly inappropriate.
I think if enough people say the above sort of stuff, this Justice Committee will go and talk to the DLUHC guys I'm dealing with, and hopefully recommend a new pre-action protocol to stop the vast majority of cases even going to a claim.
Please do the Inquiry with your various claim forms and your experience and views about all these claims you've endured. What a waste of your time and the court Judges too.
You could even send that transcript you already got free of charge, to show the Committee what sort of rubbish is causing the small claims track to be so clogged up.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

@Coupon-mad shame I didn't see this inquiry earlier. Is it definitely still open? It says it closed on 8th October. Would be happy to give evidence. Anything to help put these criminals out of business.
Yes, I brought up abuse of court process multiple times across hearings with one judge saying that I had a fair argument with regards to abuse of process and issue estoppel.
Of course this case goes back to 2018, five to six years of wasted time through the courts, so can't get much better proof of wasting the courts time.0 -
The links lead to this Inquiry not the (8th Oct closed) DLUHC one:

This Justice Committee one is the one I mean. Really relevant to you!
