PPM and BW Legal appealing after I beat them twice

  • Just to update everyone, I received an order from the court today saying the following:

    IT IS ORDERED THAT

    1. The time for the Appellant to file and serve a copy of the judgment and transcript of the hearing on xxxx be extended to xxxx
    2. The hearing listed for xxxx be adjourned
    3. The matter be listed for a hearing for the first available date after xxxx; and
    4. No order as to costs

    Looks like the court has given them 14 extra days to file the judgement on me. I believe this might be due to delays at the court getting the judgements out as I have still not received mine from back in October. I phoned to chase a while ago and was told the court has a huge backlog.
    Pretty frustrating to have to keep waiting but it is what it is.
    Keep fighting.
  • Scrolled down the Email and saw Bw Legal's email to the court. They asked for more time for the transcription company to send over the transcript.

    I phoned to chase a while ago and was told the court has a huge backlog.

    From the Court stats: 

    The mean time taken for small claims to go to trial was 51.2 weeks, 0.6 weeks longer than the same period in 2021 respectively. Compared to 2019, this measures is 13.1 weeks longer.

    So a year from the time someone gets a claim, and it's not likely to get better

    • "Free parking" doesn't mean free of rules. Check the rules and if you don't like them, go elsewhere

    You have not paid them anything yet. Your cash flow is still intact. Theirs is not. It will cost for the transcript and isn't this hearing just for permission to appeal rather than the actual appeal?

    @Snakes_Belly that is all correct. Transcription is quite expensive as well as I looked at doing it to show judge my previous hearing, because frustratingly judges never seem to put any detail in their final judgement so next judge can never comment when you bring up prior hearings. They have already lost two lots of costs orders to me and all the time sending solicitors to multiple hearings. Unfortunately, it's not even a dent in their armour for them, there are people on my mother's development who have paid them thousands of pounds in 'parking charges'. That's one person on one development. I can only imagine how much money they are making from their scam.

    This would get rid of ground rents and while it will not get rid of some costs the costs will be less if run by the residents than a management company. May work better in a small development. 

    They will have to send you a copy of the transcription.

  • Hi all, 

    BW Legal have until midnight tonight to get the transcript and judgement over to me after they were given an extension from the adjourned hearing two weeks ago citing the transcribing company hadn't got the transcript over to them. I have not received anything from them, so thinking I should email the court first thing in the morning to ask them to throw the application to appeal out as they have not done what has been ordered. 

    However at one of the last hearings BW legal sent me their WS late also and I asked for case dismissed but judge allowed hearing to go ahead still.

    Is there a particular legal way of phrasing things that I should be using in my email to the court? It is ironic that bw legal are claiming I didn't follow rules by supplying a more detailed ws at the final hearing when they have now failed to file two documents on time as directed by the court.

    I suspect they still haven't received the transcript and will ask for another time extension, but there's nothing to stop you flagging that the ordered time has come and gone...why not turn the screw!

    No special wording springs to mind but you could point out that the Court has indulged the Claimant twice already (and briefly state how) and surely the Defendant is entitled to expect finality of justice and no further allowances for the Claimant to string this application out.

    BTW if they have paid for a transcript, the good thing (once this is all over) is that you can ask the transcription company for a copy for maybe £10-£15 as it would only involve photocopying.

    That could be a useful transcript for others here in future if you were happy to buy a copy & share it (only once the case is closed).

    BW will have spent hundreds on getting it transcribed...!

  • @pinkelephant12 Thank you. I read about your case the other week. I believe I left a comment congratulating you on taking these vile parasites to the cleaners. The appeal has been transferred to Southend, so no longer Chelmsford. Will keep everyone updated as matter progresses. I have not heard back from the court yet as to BW illegal not sending ordered documents to me on time or at all as of yet. No doubt they will still be allowed to continue their vexatious claim.
