    You could put in a summary costs assessment if your costs are complicated, otherwise just as you say, standard witness costs.  It is a high bar to cross to prove unreasonable behaviour by a clamant.
    What are the standard witness costs, I can only find info on Crown court? 

    I'll be losing a days pay at £150 and I'll be driving a 250 mile round trip. Reason for travelling so far is that I picked my home court as I didn't know where I would be working (I work away from home Monday to Friday and therefore will be travelling back to work on the friday)
    Capped at £95 for a full day - take proof of your salary level (pay slips?). 40p per mile (I think); can't tell what the Judge will make of a 250 mile journey. Be ready to explain why.

    Send a statement of costs now.

    Neither party can get more than fixed costs unless the other party behaves wholly unreasonably (such as not turning up).

    That's the only way they can get the extra £300+ (otherwise they are spouting hot air).

    So don't miss this hearing and don't be late! Get there at least half hour before, earlier if it's hard to park round the court.

    Sign in with the Usher.  Don't agree to discuss the case in a side room with their rep.

    Go into the court room and see what the Judge thinks!

    - Claimant has submitted a statement of costs of £312, will this be in addition to the claimed amount (160/170 i think)? I thought there was a cap on what they could claim 
    Standard QDR stunt. They won't get that; it's capped at £50 on the small claims track, unless you completely screw up in doing what is required of you - failure to submit WS perhaps, or fail to turn up for the hearing - resulting in an 'unreasonable behaviour' cost order against you, but you seem to be well on the ball not to get caught out by any of that!
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

  • A win in court yesterday!

    Judge decided that he wasn’t satisfied that UKPC could prove their contractual right to administer tickets on the land and he also agreed with my argument and wasn’t satisfied that there was sufficient signage.
     
    He was generally quite annoyed at the lack of preparation from the solicitor and the fact that the paralegal who wrote their WS had never even been to the site.

    However he also had a bit of a pop at me for having so many arguments within my statement.

    Got awarded travel and standard witness costs

    ANOTHER UKPC ONE BITES THE DUST

    Please please please do this (SEE LINK) with a word doc of your evidence - claim form, series of debt demand letters and hearing Order.

    Tell the Justice Committee that the parking industry is prioritising court, offering no ADR and is unreasonably delaying and threatening people instead, and abusing the court system.

    Also tell them you didn't find the court procedures & instructions user-friendly for Defendants. You had to seek online help yet the Judge criticised you for trying all defence arguments.

    That cannot be right. Can't even be right that Judges have to waste time on all this parking dross.  If there was a bespoke ADR to keep parking cases out of court, then consumers would find it easier and the CNBC could cope because far, far fewer would go to a claim.

    Take a moment this/next week while it's fresh in your mind, to REALLY make a difference, to change things forever and stop this extortion that abuses the court system:
