Thank you @B789.  Will it be ok to for my husband to use the wording you have used above ("The Defendant was a patron of McDonalds. Any signs were not prominent and could not form a contract") in #3?

It's fine to use the wording so long as it pertinent to your case. Do not just blindly copy and paste.

Is that true in a case of multiple PCNs? Multiple overstays at McDonalds?

     10 pcn's for a total of £1,600.
How come? Trying to understand how this can happen ten times.  Quite difficult to spend over 90 minutes there. Was he working there on his laptop, meeting clients or taking the kids to a soft play area inside McD's or something?

#Coupon-mad, he basically went to Macdonalds and was on his phone/tablet or reading the paper. He lost track of time.  He has got more than 10 PCN's it's about 14.  He just ignored the letters until its got to this point.  He was going through a lot mentally (ongoing really). He spoke to the manger at one of the macdonalds He visits and she has informed him they have pulled out of contact with UKPC due to the number of complaints.

Add all that into paragraph 3, including the fact UKPC have been booted from that site.

OP, I haven't read back to the start, but have you posted a redacted copy of your Claim form and the PoC. It may be useful to see it.

Hi #Boat_to_Bolivia please find claim form as requested.  Can you please tell me what a PoC is.

PoC = Particulars of Claim. Nothing new there. Typical ambiguous nonsense from Yasmin Mia. Just use the template defence as advised.

Defended robustly, UKPC/DCB Legal will eventually discontinue. If they don't, they know that they are likely to get a spanking in court for their rubbish signs and PoC amongst all the other rubbish they spout.

There are fourteen parking events listed there and at £100 a pop, that's £1400.

They have the cheek to state that their cost just for trying to recover the alleged debt so far, and failing to do so, is £840.
    That's at £60 per PCN.

Then they want another £1047.80 on top of that as interest. That works out at pennies under £75 per PCN.

    What a joke.

Does this sound better for a defence:

    1. The parking charges referred to in this claim did not arise from any agreement of terms. The charge and the claim was an unexpected shock. The Defendant denies that the Claimant is entitled to relief in the sum claimed, or at all.  It is denied that any conduct by the driver was a breach of any prominent term and it is denied that this Claimant (understood to have a bare licence as managers) has standing to sue or form contracts in their own name. Liability is denied, whether or not the Claimant is claiming 'keeper liability', which is unclear from the Particulars.

The facts as known to the Defendant:

    2. It is admitted that on the material date the Defendant was the registered keeper and driver of the vehicle.

    3. The Defendant was a patron of McDonalds. He would visit the various branches in the local area usually once a day.  Whilst there the defendant would use his phone and or tablet and read the newspaper.  Due to mental health issues he found solace in these visits and would lose track of time.

    4. In the last week the defendant has spoken to the manager of one of the MacDonald’s which he has received a PCN from and has been informed that they have cut all ties with UK Parking Control due to the number of complaints they have received from their customers.
