So as an update to this, I put my SAR in and eventually got a response.  Nothing really in there but there was one letter which I didn't recognise.

Only when I looked a bit closer did I realise that they had sent it to my old address.

This was sent by Debt Recovery Plus with a date of notice of 10/02/2023 and pay timelines (see screenshot below, no personal information displayed).

However I e-mailed Debt Recovery Plus in September 2022 informing them of a change of address with strict instruction to erase my first address.  I got confirmation on 30th September 2022 that it had been actioned by Debt Recovery Plus and relevant parties had been informed.

Since September 2022 I've had correspondence from CST Law (most recent was 26th April 2023).

Can anyone advise if this is a breach of data protection by holding onto my former address and then also sending correspondence to it too?

    Thank you in anticipation.

    Many thanks
    Paul

Yes it's a breach.  But nothing will happen.

Have you replied to CST telling them that the old address passed to them by the next desk clerk at DRPlus MUST BE ERASED?

CST and DRPlus are one and the same.

Just to add, the letter I received dated 10/02/2023 was from Debt Recovery Plus, not CST Law. Apologies for the error in the post, have amended.

So it was the same company (I appreciate they're all the same, so lets say same front of company) that confirmed the erasing of the address that then sent a letter to said address 4 months later.

You can make a complaint to the ICO, if only to give your accusers some grief. Doesn't cost you a penny except for a bit of your time.

Thank you, I think it's only fair to give back some of the grief...
  • Hi all,

Received a 'letter of claim' from DCB Legal on this - complete with link to complete, which I have no intention of even viewing.

I note with considerable annoyance the following paragraph:  The amount of debt is £170.00, which includes the parking charges and debt recovery costs.  If a claim is issue, further costs will be sought, together with accruing interest at 8% above base rate per annum pursuant to s69 of The County Courts Act 1984.

    Absolute shysters!

Plan of Action is to send a slightly amended version of the suggested from the newbies thread (below) - will update if I get any further correspondence from them.

    Dear Sirs,

    Your Ref. ############
    Proposed Legal Proceedings
    Claimant: xxxxxx xxxxxxxx Ltd

I refer to your your letter of claim.

I confirm that my address for service for the time being - assuming you don't faff about and delay any claim - is as follows, and any older address must be erased from your records:
    [Correct address here]

The alleged debt is disputed and any court proceedings will be vigorously defended.

I am sourcing and seeking independent debt advice and as such, I formally request that this matter be put on hold for an additional 30 days, in accordance with the Pre-Action Protocol for Debt Claims 2017 ('the PAP').

I note that the amount being claimed has increased by a hugely exaggerated amount which the Government called "extorting money from motorists".

Don't send me your usual blather about that.
I have two questions, and under the PAP I am entitled to specific answers:

    1. Am I to understand that the additional £70 represents what you lot dress up as a 'Debt Recovery' fee, and if so, is this nett or inclusive of VAT? If the latter, would you kindly explain why I am being asked to pay the operator’s VAT?

    2. With regard to the principal alleged PCN sum: Is this damages, or will it be pleaded as consideration for parking?

    Yours faithfully

Only put it on hold if you want the claim delayed until Xmas.

  • Yes, absolutely. Thank you. No intent of delaying their games any longer than necessary.
  • Sending this today.

Think I'm right in saying it needs to go just to DCB Legal as opposed to any of the other additional companies in the same office?

    Worth requesting confirmation of receipt?
