But no advice is needed; that letter is already listed in the first 12 steps set out in the Template Defence thread which are designed to inform newbies what to expect and to avoid the same things being asked on every thread.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thanks for your advice - I have repeatedly checked MCOL and there is no update to what is stated above - although the Claimant wrote to say they had filed a DQ with the Court, nothing is mentioned on MCOL and no correspondence has been received by post. Is it the case that the claim is dismissed if by a certain time, the Claimant has not responded to the CCBC?KeithP said:iw1234 said:I have not received any further correspondence from the court (or the Claimant) - do I wait for this before filing the directions questionnaire or should I download it and complete it?
On MCOL the following is currently shown:Your acknowledgment of service was submitted on 03/12/2022 at 10:56:14
Your acknowledgment of service was received on 05/12/2022 at 00:05:29
Your defence was received on 30/12/2022
The CCBC sent you a letter, or will send you a letter, saying the Claimant has twenty eight days to consider your Defence. What you don't know is when the CCBC sent a copy of your Defence to the Claimant. It follows from that that it is not known when the Claimant has to respond to the CCBC.Further, we don't know what delays there are in the CCBC that means they don't send you a Directions Questionnaire as promptly as you might like. Can I suggest that you keep checking your MCOL Claim History and as soon as you see that the CCBC has sent a DQ to you, you are ready to download a DQ, complete it and fire it back at the CCBC, remembering to send a copy to the Claimant of course?0 -
Patience is a virtue.
As mentioned earlier, your MCOL Claim History will tell you when the CCBC send a DQ to you.2 -
3 March 2023 now - still no update on MCOL.KeithP said:Patience is a virtue.

On 27 Jan 2023 DCB sent me a copy of their DQ which they claimed had been filed with the Court - this is not reflected on MCOL - last transaction is defence filed on 30/12/2022
Are these the usual tactics - don't they have a set period in which to file the DQ etc?
Thanks in advance.0 -
You could ring the CCBC to ask if the case will be stayed (frozen...but can later be unstayed) due to inaction.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

If the Claimant doesn't file a DQ in a timely manner then the CCBC write to them giving them seven days to comply. Of course before the CCBC can do that, they have to actually notice that the Claimant is not responding appropriately.
If the Claimant still doesn't respond the case will be stayed, i.e. put to one side, and will wait there forever.
If you really do want an answer, perhaps ask the CCBC what's happening.
There's nothing more this forum, or any forum, can do on that.2 -
Thanks for your ongoing help.
I checked MCOL today and it says "case stay lifted" on 9.3.23 and also that DQ has been filed by Claimant
I assume there is no mileage in objecting to the lifting of the case stay? If not, I will just go ahead and file my DQ.0 -
No, go ahead and file the DQ.
