It ends on the 15/12 and so new claim from then, they've requested a new fit note which I'll have no trouble in getting, I'm expecting to have to have another assessment but I have evidence stating I'm unable to work. I'm mainly concerned about my savings.0

I don’t know what ‘Yes I have’ refers to.0 -
Your existing award ends on 15th December.Deleted_User said:It ends on the 15/12 and so new claim from thenEven though the ESA ends you should still be credited with Class 1 NI credits on the grounds of Limited Capability of Work.As advised by xxxxx earlier in the thread, you must leave 12 weeks and a day before you can claim again. You will therefore be claiming in 2023 and you will need to have had a full NI record for the two tax years 2020-21 and 2021-22. The NI credits you have received while getting ESA will count towards this but you must have worked for at least 26 weeks in one of the years.Information I post is for England unless otherwise stated. I do fulfill that criteria, will I receive any sickness benefit at all from 15/12 for the 13 weeks until I can claim again?0

Not through ESA.Deleted_User said:I do fulfill that criteria, will I receive any sickness benefit at all from 15/12 for the 13 weeks until I can claim again?
You are presumably excluded from UC due to the second property (unless you put it on the market) and/or for other reasons.
Does PIP apply to you?

Sounds like I can't have any sickness benefit as I have another house?0

Sounds like you have enough income, savings or assets to not qualify for means tested benefits.
And you now understand:
Your current ESA claim will remain "open" for NI Credits after 15th December.
You can claim ESA again from 10th March 2023 (do not rely on my calculation, determine this for yourself).
Your new 2023 ESA claim will be subject to conditions being met for tax years 20/21 & 21/22.
You could qualify again for ESA on 2nd June 2024 using tax years 21/22 & 22/23.
You can determine this now by looking at your earnings April 6th 2021 - 15th December 2021.
If you do not think you will qualify you can start to do Permitted Work earning LEL (£123) or higher but not higher than PW limit of £152 per week. You could be too late to do enough Permitted Work between now and April 5th 2023.
You can look at other benefits such as PIP.

So, as long as its not a means tested benefit then I don't have to declare my other house? After 15 December will the ESA be replaced by anything else?xxxxxxxx said:Sounds like you have enough income, savings or assets to not qualify for means tested benefits.

You could look into PIP which is not means tested. There is nothing that can replace your ESA on 15/12 when it ends. As you've already been advised you can make a new claim to ESA after 12 weeks if you end your claim on 15/12. You need to take personal responsible for leaving at least 12 weeks, nobody can definitively tell you you'll be entitled if you reclaim.
Just to be clear there is no such benefit as Sickness Benefit, the ESA you have claimed is the relevant benefit (and/or UC for those entitled to means tested benefits.)"You've been reading SOS when it's just your clock reading 5:05 "1 -
As already advised, no but you could look at whether PIP is relevant.Deleted_User said: After 15 December will the ESA be replaced by anything else?
When you next have a WCA if you are found to have Limited Capability for Work and Related Activity and are therefore put in the ESA Support Group the ESA will not be time limited. If still put in WRAG any ESA will again be limited to 12 months.
To be found to have LCWRA you need to meet any one of the LCWRA descriptors or be at substantial risk.https://www.entitledto.co.uk/help/ESA_criteria. See lower part of page.Information I post is for England unless otherwise stated. Some rules may be different in other parts of UK.2
