Error in item specifics

Hello Everyone

I have recently  bought an item on ebay. The item specifics contain an error in fabric composition although the photos show the label with the correct fabric composition it is small and i did not notice this having taken the written 'item specifics' as correct at time of bidding.  

What are the rules on this.. the item is not as described in the 'item specifics' that i based my bidding on.

    Sorry, just to clarify, is it :
    a. the specifics of the item you received differ to those you saw in the advert? (In which case, item is not as described and you claim your money back)
    b. The item you received matches the advert, you just misread the specifics? (you would need to ask buyer for refund but repay postage back if they agree)

  • If there was an error is the specifics you are able to claim the item is not as described and request a pre-paid postage label from the seller in order to return the item for a full refund. 

    However, from the seller's perspective they did include photos of the actual item - it's not the seller's fault that you didn't check the images properly. 

    Personally, if this was me I'd take part responsibility and pay for the shipping as long as the seller is happy to accept the return and refund the item cost. 
  • If the description was misleading in that the actual fabric composition is significantly different from the description I would expect a refund However, if it is only slightly different but you just don't like the item or it doesn't fit then I think there is a case to pay for the return. It all depends why you are returning it?
  • To be fair, images are completely inaccessible for people who rely on screen readers.  And they're not very accessible for anyone with less-than-perfect eyesight, small screens, or if the pictures aren't clear then they might not be any use for anyone.
    Sellers can't expect buyers to have perfect eyesight to be able to see all the pictures (and indeed there are people who can't at all), so it's reasonable to expect sellers to get the specifics and description right.

    If you open a SNAD case and mention item specifics do not match item received, eBay will almost certainly find in your favour.

    The 'item specifics' stated the fabric i want and can wear. 
    The photo of the label showed a different fabric that i cant wear i didnt see this and sadly the item is the fabric i cant wear

    I placed my bid using the written info having looked at the images.  I was using a phone and i didnt spot the fabric composition was different on the label in photo .. otherwise i would have queried before bidding.  

    I messaged the seller but they are stating the item specifics are automatically entered and the photo is the description so the item is as described. 

    Its been a while since i sold anything via ebay .. but i thought there was a message telling you to check item specifics and choose from drop down boxes as they were part of sale description.  

    I dont want to be unfair.. but I also dont have the money to just right off a top if i can have a refund and post back

    I tried asking under not as described.. but they declined - twice and i now have to wait a few days before asking ebay... daft but its hanging over me. 
    I feel stupid..
    but also that if i'd made this error id refund .. i've messed up before selling, thought something worked fully it didnt and  apologised and refunded.  
  • Yes, if it's a completely different material get a refund as you're entitled to it.
  • As the seller is not being accommodating, stop communicating with the seller. 

    Go to your purchase details page on eBay. 
    Find the listing and select 'Return this item' in the drop-down box next to it. 

    Raise a 'not as described' claim via eBay stating the item is a different fabric to what is stated in the auction listing. There is no need to get into details about what the images show, unless eBay request further information (which is unlikely). All you need to say is 'Item received is made from a different fabric to that what was stated in the item description'.

    eBay will then email the seller, who must accept the return since it's not a change of mind (only change of mind returns can be declined by the seller). 

    The seller will have to provide a pre-paid returns label - wait for this. Do not do anything until you receive this label via eBay - even if seller asks you to post to an alternate address, or at your cost etc. Do nothing until you receive instruction and the label from eBay. 

    Package the item up well, use the pre-paid label, and return the item. 
    When the seller receives it, they have 2 days to refund you - if they don't then eBay will automatically refund.
