I have had a reply from the landowner, just wondering what people's thought are and if this is an avenue worth pursuing:

"Similar incidents have occurred in past and I know of one case where it went to the court and she won on the ground that the paying sign for parking was not clearly displayed at the entrance.
Now there is construction work going on the corner at the entrance makes the sign even more obscure
The penalty charge is ruthlessly disproportionate considering it’s £2-3 for the length of time you parked.
On personal level, I don’t have any dealings with Manor Parking Limited. However if you need the evidence that you have indeed been to the pharmacy then i can send you the details from the patient medicine record system.

    Kind Regards"

I have also contacted my MP who has written to the company and I sent a SAR this weekend

Keep that email as evidence and do ask for the proof of using the pharmacy.  Gather all your evidence now, including getting some damning (date embedded, ysing an app) photos.

  • Hello all,

Thankyou so much for the help you have given me already, please can I ask for some more advice?

Following on from advice in this group I contacted my MP. A few days after this I sent a SAR to Manor Parking and contacted the solicitors asking them to put the case on hold for 30 days again as per advice from this group.

On the 8th Dec (which was about four days after the company would have received the SAR) I received the following email from my MP:

    Dear ----------,

I have received a call from Manor Parking to say they have cancelled the charge and they will be in contact with the debt recovery team to also cancel.

Hopefully this helps you and I am sorry for your stress.

    Kind regards,

I was hopeful that this meant it was over, however today I have received a letter from Manor Parking which is dated 9th Dec.

It thanks me for the SAR and has asked for proof of identification. (I forgot to enclose my V5C), and says once they receive this they will deal with my SAR in one calendar month.

Does this mean that they are still pushing ahead with the fine despite telling my MP they were not? Or do they legally have to answer a SAR regardless of whether they have decided to cancel the fine or not.

Should I just ignore this? There is an email address at the bottom on the letter, should I email them and ask if they have cancelled the fine or not?

    Many thanks for any advice

They still have to legally reply to a SAR.  Ask them to include the correspondence to and from your MP because you understand the PCN is now cancelled and want that evidence too.

  • Thankyou for this.

All my correspondence with them so far has been written, is it ok to email them to the email they've provided instead?

Is an option to just not reply and assume its cancelled? or is that a bit risky? I am quit happy not getting the information to the SAR if they can confirm that the PCN has been cancelled

It is not a fine. Do don't use that word in any correspondence, but it does look like good news though.
