NSL Stanstead Airport

We were photographed at Stanstead Airport by a cctv vehicle stopping on a double yellow line a bit after a sign on the road saying "bus stop". It was for no more than 10 sec as the screen of the vehicle was showing some error message so I panicked and stopped to sort it out. The place where the car was stopped was just after the no stopping sign and the road marking for the bus stop. To be honest I didn't noticed any of them at 00.45 in the moment of panic. To make it worst and for this I am even more embarrassed I appealed within the 14 days... I don't why I did it although I knew the rules. I appealed using Edna Basher's template as it's a company car. Consequently, the appeal was rejected.
Today searching through the forum I found a thread about POPLA NSL Stanstead Airport from a forum mate "johnnypjr" and was wondering whether to go to POPLA using his example, or to continue with Edna's if at all I have any chance here.

As it's a company car did the first PCN go to the company, who then named you as the lessee?  Using the Edna Basher appeal was correct then.

    Search the forum for:

    - HIRER POPLA APPEAL

    and separately:

    Airport byelaws POPLA appeal.

  • Hi,

Yes, the PCN went to the Lease Company, who then directed them to us.

So the Hire firm HASN'T named you as lessee/hirer but NSL have issued YOU with a POPLA code.  Odd!

I assume you appealed to a Notice that wasn't addressed to you?

Exactly like I said, they've not transferred liability, not named you and you haven't been sent a PCN in your name.

Yes - and you will probably win because the POPLA Code has been issued to you personally, not the company.

Copy any Notice to hirer POPLA Appeal (obviously your keywords to search the forum).

  • Hi there,

POPLA has finally responded to my appeal, here is there response:

"We have noticed that you are not the individual the operator is pursuing for this parking charge.

For POPLA to review your appeal we require Leaseplan UK Ltd to authorise you as a third party.

They can do this by either:
      *   Sending an email to info@popla.co.uk authorising you to deal with the appeal on their behalf; or
      *   Calling us on 0330 159 6126 and providing authority over the phone. Our office is open Monday to Friday 9am - 5pm.

We require one of the above by 28/2/23. If we do not receive this the appeal will be withdrawn.

This will leave the balance of the parking charge payable, and should you wish to continue disputing the charge you will need to seek independent advice"

I believe, I should just send them the third party authorisation letter, as shown above in my message from 13th of November. Is there anything else that I need to add in order to support my claim?

    Many thanks

    Pat

Try sending that letter IF it authorises you to appeal.
