    Thank you for your patience whilst we investigated your complaint with the Operator.

     

    The Operator has confirmed your parking charge notice was cancelled as soon as they were made aware of the issue with the timings. 

     

    The Operator has reviewed the camera and contacted their technical team to determine if there is a wide spread issue.  The technical team believe the camera timing lost connection which caused the issue on the cameras. 

     

    The Operator has shared with us a detailed breakdown of the checks they go through to ensure the readings are accurate.  The Operator has also acted swiftly when the issue was raised.

     

    Due to the appropriate action being taken by the Operator, we have closed the case.

     

    Thank you for bringing this matter to our attention.

    Rather funny how if they mess up times they get to illegally request my data from the DVLA and have no come back but if we mess up time we get threatened 


    Where do i go from here as BPA dont seem to be penalising the agency

    The BPA are totally useless they should not be closing any case until the incident has been fully investigated, the "wide spread issue" fully reported back, along with the actual numbers of affected vehicles and the cancellation/refund of any PCN's paid due to thieir error.

    That fob off just isn't good enough the operator checks are either not good enough or not being done as this problem has been highlighted by multiple motorists and not the operator.
    The real issues here are:
    1) A PPC that is operating with impunity
    2) ANPR yet again showing it is not fit for purpose, the government should ban its use
    3) The BPA are totally inept in their self appointed role, any legitimate ATA would not let the operator investigate themselves in this way they would conduct a full appraisal, they would insist on an action plan to ensure this did not happen again.

    Maybe a list of double dip cases and ANPR errors reported on here and elsewhere could be started, to highlight how many times these one off errors occur

    It would be worth the OP or one of the other known victims, or anyone else for that matter, deliberately doing a double dip, with operational dashcam and mobile 'phone tracking enabled to see if happens again.

    ... and the DVLA. Note that the DVLA selling your personal data without carrying out suitable checks, and the PPC obtaining and processing your data without reason is unlawful (civil/contract law) not illegal (criminal law).

    You have to make these complaints before you can escalate them to the ICO.

    If you want to stir the pot some more, you can ask the Park Tawe council planning department if planning permission was obtained by the PPC for the ANPR scameras and advertising consent for their signs.
    Not having the latter is a PoFA para 12 breach and a criminal offence, although only the council can pursue it.

    Depending on what you find, you may then want to complain to the landowner, the council, and your MP again about this (possibly) new issue.

    Get together with the other victims by pm, swap info and jointly complain to the DVLA complaints email, telling them what exactly has happened and that this isn't just another ANPR issue, the BPA has admitted (I think?) that this parking firm actually overwrote arrival times with what appear to be MADE UP times, because the ANPR system 'lost' the real data.  They then (going by your evidence and that of other victims) issued multiple PCNs using the imaginary arrival times.  And not just once.

    Also DO complain to the ICO with your evidence, and state that cancelling the PCN was not enough to address this issue, especially as you have evidence from others, that this is NOT a one-off and NOT just from one day.

    Go for the jugular with both complaints but get in touch with the other posters linked and mentioned earlier on your thread.

    ICO complaints are done online - easy!

    But do not concoct a template letter, so much better if all written from the heart (different hearts)!
