That's why it's covered in the NEWBIES FAQS thread at the top of this forum, to help new posters understand what happens and what to do.How does the defending bit go, it's a big unknown to me.

You are eons away from that. Plenty of time to do lots of reading and research so that if the day comes, you'll be well genned up.Derd said:How does the defending bit go, it's a big unknown to me.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

hi,
The reason I wanted to have information on the Claims and court bit was that the incident occured in Hounslow, London and I live miles away in Coventry.
So, if steps 1-4 go through and I get a claims sent, do have to physically travel to a court, which might be Hounslow in my case, does it get a bit complicated ?
1. Plan A - I no sent an email to VistaCenter, lets see!
2. Plan B - denied(assuming)
3. 10000 letters - ignore
4. Court claim
Note: I understand I may be asking repeated questions, Im just a bit lost in this puzzle!

If this case ever gets to court, as a private individual you will be able to choose a County Court convenient to you.
So as you live in Coventry, you might want to choose that the case be heard in Coventry County Court.
But as @Umkomaas said, you are a long way from any court hearing.1 -
@KeithP, @Umkomaas and @Coupon-mad,
I've not been here long and just want to be up for it if and when the day comes which is why I want clarity on the court proceedings.
Re interating everything:
Done:
1. Plan A. Ive now sent a mail to the building, that may be my last try.
yet to be done:
2. Plan B. Appeal to CPM using the template(including the mods by @Coupon-mad). That may lead no-where but I've heard the courts happy to see you tried.
3. Dont know what happens apart from debt letters which I will have to check to look for a Court claims.
4. Court claim. Dont know how to handle this. Do I need to appoint a lawyer and run around to get things like paper work and my claim in line with whats needed to win the claim.
Please can I also have a rough timeline of these things(weeks, months) considering:
1. the incident happened on 29/10/2022.
2. the notice issue date is 04/11/2022 and
3. the letter was received on 09/11/2022
when should I send the appeal to CPM?
am assuming, I do not need to make any further appeal
what happens after that ?

What made you think the location of the parking charge event affects your choice of county court?
The only thing to keep on top of is if you move house within 6 years which of course you MUST tell the PPC in writing, to be certain you never miss one of their tedious debt demands. Open all the letters but don't tell us about debt crawlers please.
Come back if you get a claim.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Apologies in advance if i am breaking forum rules, i read through NEWBIEW FAQs but still not clear and found this post very similar to my situation.I am in similar kind of situation and got a PCN from UK CPM for Vista center parking.Situation: entered the Vista center car park, Hounslow (ANPR time 10:56), started the parking session at 11:03 with wrong car reg number. I started the parking session with my car reg no but that day i was driving my partner's car.Realized the mistake at 11:35, started a new parking session in JustPark with correct reg. number.Next contacted the JustPark customer support on chat, explained him the situation. while chatting with agent around 11:40, i had two parking session for both the cars my car (wrong) and my partner's car (correct). After chatting with agent, he cancelled the parking session started at 11:03 for wrong car reg.1st parking session started with wrong car reg. started at 11:03, ended at 12:04 (cancelled by JustPark agent)2nd Parking session started with correct car reg. started at 11:36, ended at 13:37Total stay as per ANPR: 2 hours 37 minutes, parking session covers 2 hours 34 minutes but 1st session was against wrong reg.PCN received via post to register keeper: 17/02/2023 (my partner is register keeper and i was driving my partner's car)Appeal to UK CPM: 17/03/2023 (Sorry i mentioned the driver information in appeal that i was driving, I wish i could have read the MSE forum ealier)Appeal rejected from UK CPM: 05/04/2023email with rejection stats this - "Please note, a new notice will automatically be generated and sent to you, as the liability has been transferred into your name. This is for your records only and does not allow you to appeal again internally or transfer liability. You now have 14 days from the date of your new notice to make payment at the reduced fee of £60.00. If payment is not received within 14 days, the fee will increase to the full amount of £100.00."But i am still waiting for new notice (NTD) as of today 19th April 2023.
Reason given in appeal rejection "Whilst we note the comments and reason for appeal advising you made payment, we can confirm that insufficient evidence has been provided to substantiate your claims. Payment was not made for your full parking period. The photographic evidence indicates the length of time the vehicle remained on site; this information is then cross-referenced with the data from the payment services.
The vehicle remained on site for a total parking period of 2 hours and 37 minutes, meaning the whole period of parking was not paid for. By remaining on site, this means you are agreeing to the advertised terms and can comply with them. As your vehicle was not authorised to remain on site for the full duration of stay, we can confirm that this PCN has been issued correctly. "I read the NEWBIES thread and it clearly stats NOT to appeal to IAS. Just wanted to check if my case can be considered for a successful appeal to IAS? As per the UK CPM rejection on 5th April, it ask me to appeal to IAS within 21 days i.e. by 26th April.Need an advice here.Note: I have already sent the email to forum team to change my username as i used traceable username.Cheers!!
