Either copy in the solicitors or don't. Your choice.  No biggie and not mandatory.

    Yes, quite normal.

The CCBC sent you a letter, or will send you a letter, saying the Claimant has twenty eight days to consider your Defence.
What you don't know is when the CCBC sent a copy of your Defence to the Claimant.
It follows from that that it is not known when the Claimant has to respond to the CCBC.
Further, we don't know what delays there are in the CCBC that means they don't send you a Directions Questionnaire as promptly as you might like.
Can I suggest that you keep checking your MCOL Claim History and as soon as you see that the CCBC has sent a DQ to you, you are ready to download a DQ, complete it and fire it back to the CCBC, remembering to send a copy to the Claimant of course?
  • Ah thankyou! i've logged into MCOL and it does say "DQ sent to you on 28/11/2022" but i havent got anything via email - is that where its sent?

No, Royal Mail will deliver it... sometime.

But now that you have seen that it is on it's way, you can move on - following the guidance in the next lines of that checklist you were using when you filed a Defence.
  • as in, should i get started on the "Witness Statement & evidence and costs assessment stage" now?

Is it at all likely that the claimant pulls out of the case from here?

    Not yet they won't.

And no, WS is not next. The first 12 steps are in the Template Defence thread, first post.

  • Cool so on step 8 i should just download it instead of waiting for it to come through the post and email it back to them?

I thought my next step was to just wait for it to come...not move onto next steps

The problem with waiting for the DQ to be sent by most is that it may never arrive. You know it is on its way so there is nothing stopping you from downloading your own and sending that as long as you do not use one sent by the claimant.

Stick with the 12 steps then move on to 'IMPORTANT: Know What Happens When' in the NEWBIES thread 2nd post all about court stage, which walks you thorough later stages (WS, evidence and hearing).
