County Court Letter BW Legal

2

Comments

  • The facts as known to the Defendant:

    2. It is admitted that the Defendant was registered keeper and driver of the vehicle in question.

    3. On the date in question the defendant was visiting the blank for a rare quick lunch time drink with his colleague. The defendant did not see any signs when he entered the blank car park so he did not realise any registration of his vehicle was required.

The defendant also did not realise any of the claims letters sent to him were legal.

The defendant works hard, has a young family and rarely has any lunch break and he requests the judgement be countermanded on this occasion.

Does this sound ridiculous? I’m struggling to word it without thinking anything i write is ridiculous even though the whole claim is a shambles…

Remove all this and just stick to the fact there were no conspicuous signs:
The defendant also did not realise any of the claims letters sent to him were legal.
The defendant works hard, has a young family and rarely has any lunch break and he requests the judgement be countermanded on this occasion.

So are you saying keep it short and sweet or add to that part about the signs?
  • Where do I obtain BW legals email address for when I want to CC them in the defence email?

Search the forum but I had these from previous postings: -
    parking@bwlegal.co.uk
    disputeresolution@bwlegal.co.uk
You don't need to send a copy of your defence to BW Legal assuming it is a first time defence and not a set-aside (I haven't been back through the thread) as CCBC will send it to the claimant.
  • Just received this letter? Is this bully tactics or should i be worried especially at the mention of a CCJ.

I got one of those too. Hundreds of others have the same - it's number xx in BW Legal's template pack.

Automatically issued without reading anything in your defence.

    Ignore it.

    Standard guff. IGNORE. Crack on.

Re-read the first 12 steps in the first post of the Template Defence thread to be ready for the next form from the court.

What are you confused about? This is simply the next step and you are being ordered to do somthing which you should have been expecting.
