    Lynwen, why should CPW refund your money just because you have changed your mind and decided you no longer want the goods which you had agreed to buy?

    Ok, many retailers do do this, but it is only a goodwill gesture. Maybe CPW has decided that it can afford to upset a few customers while it strives for a greater profit. Ebay is probably your best course.

    was it a contract line. if so it is arguable that the supply of the phone is a collateral contract (ie secondary to the main contract for the airtime) and CPW were acting as agents alternatively CPW is the retailer (it's never clear who is what in these cases) and that there has been a breach of this contract in that s.14 Sale of Goods Act 1979 has been breached.

    if it as a pay contract. then the contract may well be directly with the retailer in which case just sue CPW.

    I think it should be clarified that under distance selling laws you have the right within 7 days to return the UNUSED item.
