Lynwen, why should CPW refund your money just because you have changed your mind and decided you no longer want the goods which you had agreed to buy?Ive had the a similar problem with CPW. My daughter bought a memory card for her sister's phone as a Christmas presant, in the meantime I had sorted my other daghter's memory card out and it was working fine. I told my daughter to take it back to CPW, as it was unopened and she had the reciept... she took it back after 10 days and they told her they wouldnt take it back... My daughter (only 15) threw a tantrum in the shop, but they wouldnt budge!!!!!!!! so now we have a new memory card that we dont need. Ebay here we come I think...
I will never ever shop in CPW again.
Ok, many retailers do do this, but it is only a goodwill gesture. Maybe CPW has decided that it can afford to upset a few customers while it strives for a greater profit. Ebay is probably your best course.0 -
I've bought a phone from CPW, that is faulty. I took it back after 31 days asking for a refund, and they refused, saying that it was more than 28 days after purchase.
I tried to explain that the sale of goods act over-rode their stupid 28 day policy, but they wouldn't budge, and would only offer a repair, not even a replacement.
Any suggestions to get a replacement, or even a refund?

was it a contract line. if so it is arguable that the supply of the phone is a collateral contract (ie secondary to the main contract for the airtime) and CPW were acting as agents alternatively CPW is the retailer (it's never clear who is what in these cases) and that there has been a breach of this contract in that s.14 Sale of Goods Act 1979 has been breached.
if it as a pay contract. then the contract may well be directly with the retailer in which case just sue CPW.0 -
Why would you want to buy from a CPW store anyway?!?! Buy online, always better deals and you are protected by the distance selling regulations meaning that you can return any product without a reason....
CPW employees will tell you any bulls*it to get their comission, hence why they were on watchdog the other week for miss-selling insurance on the iphone by lying....

I think it should be clarified that under distance selling laws you have the right within 7 days to return the UNUSED item.0
