Being chased for fines from 3 years ago

I’ve received a letter before claim from SIP for two £100 private parking fines for ‘insufficient fee paid’ dating from June 2019 and Jan 2020.
This is the first correspondence I remember receiving on this for at least a couple of years. Not surprisingly I can’t remember why I didn’t pay the sufficient fee.
Any tips on how to proceed, do I have a right to ask for further details? How likely does anyone think they are to pursue the case.
I lost my last private parking court case.

First of all these are not fines, there is a seemingly pedantic, but very important distinction. They can go after you taking it to court should they want to which is why its important not to ignore, as this was some time ago it will be hard to recall who the driver at the time was so do not try and guess this.So lets start with a few questions:Why did the vehicle get parking charge notices if known?who's car park was this, that is if you know - ie supermarket, retail park, or a standalone car park ( ie tatty bit of land in manchester)and where was it?You saidThis is the first correspondence I remember receiving on this for at least a couple of yearsDid you receive anything in the past? do you still have it?

The guidance is exactly the same as given on your earlier Excel thread.2

In answer to your questions, I can’t recall exactly what the PCNs were for but I assume it was for overstaying the time I’d paid for.Half_way said:First of all these are not fines, there is a seemingly pedantic, but very important distinction.
It was a stand alone car park in Manchester.
I can’t remember whether I received anything in the past, if I did, I will still have the papers but don’t have access to them at the moment.
thanks for the advice.0 -

Manchester seems to be infested with scabby car parks also infested with Sip
I can’t remember whether I received anything in the past, if I did, I will still have the papers but don’t have access to them at the moment.I would suggest that you dig these out and check to see if they comply with the protection of freedoms actThis is the first correspondence I remember receiving on this for at least a couple of years. Not surprisingly I can’t remember why I didn’t pay the sufficient fee.Three years, or even two years is a long time to go back, odds on that as a private individual you will not have kept and retained a log book of who could have been driving the vehicle at the time.If they do not comply with the protection of freedoms act (POFA) then they can not hold the registered keeper liableSip have come up on here before in the past, so maybe some of the other regulars may be able to advise further on POFA compliance and Sips track record, you should also try and dig out the original letters, if you dont have them then you could ask Sip for a copy under GDPR (subject access request - SAR)weather or not that would be an identical copy and not a modified mock up remains to be seenPrivate parking companies can go after people for upto 6 years after the event during which a lot of personal circumstances can change ( addresses etc) - there does need to be something that stops PPCs and the like from resurrecting cold cases something like after 14 days from the initial event then they can not pursue, and if they fail to provide updates for more then two months the case is considered closed and no further action can be taken. But as it is the PPC world is unregulated, and despite the likes of the BPA saying they are respectable (?) each time a real attempt is made to rein in the industry the likes of the BPA throw their toys out of the pramFrom the Plain Language Commission:

The first question to ask yourself is "is my V5C up-to-date with correct, current address and was it at the time of the alleged events?" If not, it should be dealt with urgently. Also you need to inform the DPO of SIP of your correct address for service and require them to ERASE any old data and inform any and all of their agents.Olibird said:This is the first correspondence I remember receiving on this for at least a couple of years. Preparing my defence for this case. The forum guidance for newbies 2 says ‘ Most claims do not even state the alleged breach (QDR claims excepted). If yours doesn't state the breach, add the paragraphs and judgments seen in the defences by @andyl3004 and @xavian1234 (THOSE ARE LINKS) and change the paragraph numbering to accommodate the extra words.’
Their Particulars of Claim states ‘the charges were incurred as the terms of the contract (‘Sign¿) were breached but it doesn’t specifically say what the breaches were, so I assume I should add those paragraphs?
Member ids are given as links, but that’s all I can find, the links just take me to their profile pages. Any ideas please?

I changed it yesterday. No longer says that. But take a closer look what a posting profile shows...PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

One idea might be to look at the threads/posts of those people - that's what you are expected to find from their profile pages.Olibird said:Member ids are given as links, but that’s all I can find, the links just take me to their profile pages.
