Parking fine claim county court business centre

Hi I am trying to find some help regarding a parking fine. reading your advise and posts on MSE has made me lot less depressed now.

I was wondering if you are able to guide me in any way please.

I received a claim yesterday from County Court business centre Northampton regarding a parking fine from April 2022. On that day I was collecting my elderly father -who has very limited mobility and holds a blue badge- from a underground station. Front of station one way street with double yellow lines and bus stops on both sides, beside it is a small private car park, as I entered this car park looking for a parking spot or diasabled bay I  realised there aren’t any, I turned the car round to leave and spotted a signage by the exit, entrance and exit same way. This signage is only clear after you enter the car park. Before I could finish reading this signage while in the car a gentleman  informed me I may have just got a ticket from a parking enforcement vehicle with camera. It must of sneakily taken photo of my vehicle while it drove past, otherwise I would have certainly noticed it had it stop. I then drove out.

appologies for the long post. Please help me with the witness statement and defence or direct me to any that relats to my situation.

The claimant is Parking Control Management UK Ltd

solicitors- Gladstones.

thank You so so much for reading and any help guidance will be immensely appreciated.

With a Claim Issue Date of 13th October, you have until Tuesday 1st November to file an Acknowledgment of Service but there is nothing to be gained by delaying it.
To file an Acknowledgment of Service, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.

Having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Tuesday 15th November 2022 to file your Defence.
That's almost four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service guidance.
Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.

Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.

    It isn't a fine.

What you describe is easy to defend.

A scam, predatory PCN that PCM are infamous for, over the years:

    http://parking-prankster.blogspot.com/2017/01/pcm-uk-lose-case-on-heath-parade-scam.html?m=1

(The Judge) "dissected PCM UK's evidence, showing they had proved nothing - just a car with Mr X inside for 2 minutes and 14 seconds. There was no time noted when Mr X came into the bay and no time when he left and that 2 mins 14 sec was not enough time to read signs as the driver was still in the car.

He stated that as Mr X hadn't been given the opportunity to read the terms at the site there is no claim here and dismissed the case.  Everything was over and done with in 10 minutes."

Easy enough to beat now you have the claim.  It'll be killed off in 2023...you are on the home straight as long as you follow the whole process.

Follow what the NEWBIES thread second post tell you to do, and show us your planned defence paragraph 3 that you want to add to the Template Defence.

Hi guys, I went back to take some pics

I’ve circled the “private land” the arrow showing where I turned in. If I remember there was a bus on the bus stop which may explain why I didn’t notice this sign. The sign I noticed is behind the phone box at this point.

Realising there are no parking bays or for blue badge holders, turned around and noticed this sign, stopped to read from my vehicle at no point did I come out of the car,I only stopped for a short while before driving out, I’m assuming this is when the enforcement vehicle with camera took a sneaky picture of my vehicle.

This is the sign approximately 6 feet high and most of the writing is very small print.
How did I agree to contract !?

Please read other defence threads to learn from how other newbies do this (all like you, no legal training).

We don't write paragraph 2 & 3 for people. We need to see what you think you want to say - your draft. Then we'll help if it needs tweaking!

    Be confident.

Ok I’ll give it a go. Looking at the photos, in your opinion what are my chances and is there anything you would suggest in particular that I should include in my defence.
