Yep, that's the one, and very useful if it ever gets to court because it was an appeal case and therefore persuasive on the lower courts.
I married my cousin. I had to...
    I don't have a sister. :D
    All my screwdrivers are cordless.

  • This is what they've now emailed across, do I have to request a POPLA code from them at this stage?

Why do you need to do that?

    That email says...

    and also...

Clearly you aren't going to tell them who was driving, so just wait for that seven days to pass and you'll get your PoPLA code automatically.

Interesting to note that the first sentence of that email makes the reader think that supplying the driver's details can make a difference to the appeal decision.

Clearly that is not the case.
As we all know, supplying the driver's details reinforces the case against the motorist.

Is there something here that the BPA need to be correcting?

I think the BPA will say there is no breach...

What utter codswallop these scamming idiots talk.
When travelling at 70MPH a motorist is not expected to read a small wordy sign, a sign on a fast road is large, simple and easy to read and most importantly covered by The Traffic Signs Regulations.
UKPC arbitrary signage is supposed to comply with the BPA Code of Practice (which it rarely does) and is covered by this woolly tripe:
    Entrance signs must follow some
minimum general principles and be in a standard format.

The size of the sign must take into account the expected

speed of vehicles approaching the car park, and it is

recommended that you follow Department for Transport

    guidance on this.
I have never seen any evidence that the BPA does any on site checks, the inference is that they audit their members from the confines of their offices and let them carry on regardless.

  • The whole point about this thread is that UKPC claims there are restrictive hours ?

The signs on both entries DO NOT mention this and one is hidden by bushes and a barrier gate
Anyone driving in will only see an invitation to park for 3 hours, regardless what time they enter the car park

Regarding the UKPC reply, again asking who was the driver is their nonsense. It really does not matter who was driving because the entry sign made a statement .... 3 hours parking with no mention of restrictive hours.

To quote someone driving at 70MPH who must read the signs is utter rubbish.

To be clear UKPC ... road signs are very clear and visible unlike UKPC signs where you need stilts and a magnifier to read them

But the signs in the car park are irrelevant as the contract is formed upon entry and that sign clearly says 3 hours parking with no mention of restrictive hours.

As you know there are two gates which can be used to block entry but they are not used forming a money trap for those window shopping who believe they have 3 hours parking

There is another thread on here about UKPC and the car park just around the corner, being TGI Friday and other shops.
Only ONE entry and there is NO entry sign warning people

Difficult to know what POPLA will say as for sometime now they have proven ignorance

You can only ignore such a stupid letter from UKPC, get your POPLA code and let's see

Good news I've received an email from the landowners confirming the PCN has been cancelled! Didn't expect that as I sent the email a while back.

I've never seen the gate closed during the restricted parking hours so UKPC are taking advantage of anyone who enters the site.

Thank you for all the support and feedback.
Brilliant.    I have never seen the gates closed either.

Either they close the gates at night or tell UKPC to put up "plain english" signs clearly visible at both entrances

For our future reference could you please tell us who the landowner is so if nothing changes, we can scupper UKPC faster and stop their rubbish

And if you or your family ever venture in the TGI Friday car park, the entrance is on the Caversham Road, it's another UKPC money trap but this time THERE ARE NO UKPC signs upon entry .... only this one

  • Thank you for the heads up. That sign is worse than the ones at The Forbury Retail Park.

I found the landowner from the above article and the company following a Google search. The email address I contacted is customer.services@aberdeenstandard.com, my email must have been forwarded on to the relevant persons as I was contacted by Real Estate Advisors JLL stating the PCN was cancelled.

Hope it helps those in a similar situation.
