Has anybody claimed compensation for a delay using EasyJet`s own form?

    Do you live in U.K. or Isle of Man ? 
    This is relevant to how many additional expenses you would have incurred - if you live in U.K. there would minimal additional expences incurred ( taxi or train fare home & back to Gatwick )  - if you live in Isle of Man then you’d be entitled to claim for meals and accommodation for the extra 4 days in U.K. 

    In addition you may be entitled to claim compensation , as long as the reason for the cancellation was not extraordinary circumstances which the airline had no control over ( such as bad weather or Air Traffic Controllers strike ) . 

    Always worth submitting a compensation claim . Were you given a reason for the flight cancellation at the time ? 

    Thanks, they have paid the reasonable expenses as we live in the Isle of Man and needed hotels. They have said no compensation as it was French air traffic. As the flight would not pass into French airspace, I have queried this.
    We were pleased with the swift pay out of the expenses as even the Premier inn was not cheap at that short notice and busy weekend.
  • Nikiya - I made two separate claims, one for expenses, one for the cancellation, hence the two responses although that doesn't explain why those responses conflicted. I hope dreddypuss got the payment through in the promised seven days . . . mine never arrived. I was advised on this forum to make a civil claim via MCOL, which I did, and easyJet has today acknowledged service of the court papers and ticked the box indicating they intend to defend the case. This is despite me having emails from them conceding the claim for compensation, saying they would pay within seven days, then asking for more time, and then after five months of chasing saying that due to an unspecified technical error they could not process my claim and I should therefore go back to square one and resubmit it for their assessment. I refused and told them that as I had it in writing for them that the flight had been cancelled (due to 'crew issues') and the claim was accepted I didn't see what there was to assess. I don't know if easyJet and other airlines always tick the box to say they are going to defend a claim on receipt of court papers but I don't really see how they've got a leg to stand on. I'd be interested if anyone who had taken them to court has any observations about that.  However I will go to court if necessary on a point of principle as the treatment I have had from them is disgusting. Not everyone will agree with this I guess, but on a further point of principle I won't be flying with easyJet again, whether they're the cheapest or not. Their customer 'service' sucks and I'll be approaching my MP and media in due course to highlight these issues.

    I wonder if EasyJet are perhaps adopting a similar attitude to Jet2, i.e. awaiting the outcome of the Supreme Court's judgment in Lipton v BA CityFlyer - the original case concluded that crew sickness wasn't extraordinary circumstances and therefore compensation is payable, but airlines are obviously hoping that'll be overturned....

    Crew sickness

    The question of whether compensation should be paid in the event of crew sickness is currently being considered by the Supreme Court (the highest appeal court in the country) in the case of Lipton v BA City Flyer. We are not currently processing claims related to crew sickness until after the ruling. We would be happy to look again at claims after the court has clarified the law.
