    oh how frustrating for you! It took us weeks and weeks to get to that point, ours was paid for four weeks ago.
    This sounds exactly like us. It was flagged back in July and we’ve been pestering them since then.
    Yup! June we flagged it, it was clear as mud in the mortgage terms. But they wanted the management pack first to confirm which took 8 weeks to come then all the we need it we don’t back and Forth. Been 3 weeks now- going into the 4th since it’s been paid for! 

    We are also in process of getting a ne mortgage as ours ran out!
    We’ve had no info about a management pack. So wonder if that’s what they have been doing.

    We’ve 8 weeks of our mortgage offer left with a possible 2 weeks extension so praying is all done by then or we will be pulling out and renting
    It’s so stressful isn’t it! Have Premier given you indication at all? They aren’t telling us much at all! I hope you get sorted in time 
    Very stressful! We have been told by our conveyancer ‘other clients’ have taken 6-8 weeks to draft the DoV.
    That’s just to draft too!!!! We’re about half way then 😂 it’s more than they’ve ever told us. We asked if it would be done by last week and they were like yea this is doable (this is when our mortgage offer ran out!) least with a new mortgage offer (hopefully!) we’ll have another three months to play with but we need to be in by the end of December for school applications!

    Sorry I meant draft and signed. We’re pretty much in the same boat with schools as well. My youngest is in nursery and we need to apply for primary school by 10th January so we can get her into the same school as her sister. Just hoping we have enough time.

    If we go all the way to mortgage expiry for completion it will be a massive 31 weeks since we offered on the house.

    Have the management company actually agreed to the dov? If so, hopefully it won’t take too long. The real problems arise when the management company either don’t respond or refuse a dov.

    Not to put you off, as my situation is probably an extreme example, but this was the reason I had to pull out of a purchase earlier this year – management company being completely uncooperative for 7 month.

    Wow! Is that because they wouldn’t agree! They have agreed, it’s been paid for an passed to their solicitor to do about three weeks ago now!
  • In a similar situation. Been in enquiries two months and this has been going back and forth for ages. Mgmt company have said the 13 properties on the estate have managed to get mortgages without a DoV so it's not needed. We are trying indemnity with our lender and am panicking now. It's basically the last enquiry we have :(

    They wouldn't respond at all. 

    Unfortunately the management company and/or their solicitor have no real incentive or rush to get these kind of things done. That's why they take so long..  you just have to keep pushing them. Its frustrating because it massively affects you, but it doesn't affect them.

    In my opinion there should be a legal requirement for them to be more cooperative than they are, as it is affecting people selling and buying. On the estate I pulled out of I know that the houses up there simply cannot be sold right now, purely due to the management company.

    Absolute utter nonsense. Don’t listen to a single word that comes from a free hold management company. Even the well established, more well known companies are borderline criminal.

    The vast majority of lenders require dov, which would include at the very least a clause stating that notice must be given to the lender before any repossession is taken. They are tightening these requirements, which would explain why more and more of these thread keep popping up. You can Google for the lenders handbook, it will give you all of the lenders requirements. I believe with the house I was looking at, there were only 2 or 3 lenders who would agree to lend without a dov.

    Just because other properties have managed to get a mortgage without at this moment, doesn’t mean you don’t need one. You could have trouble selling in the future. You could also have trouble re mortgaging, especially if lenders change their requirements.

     


  • So been researching and we will be a shareholder in the management company and most lenders say that's an acceptable requirement for rent charges.

    Makes me question why my solicitor is asking about indemnity? Think shes missed this!

    Also makes sense why the management company is saying no one else on the estate has needed anything as they haven't needed to as we are all shareholders of the mgmt company. 

    Wording from a lot of lenders :  rent charge acceptance
