DCB COUNTY COURT CLAIM - CCBC

Hello, I hope you are well.

Thank you for your very helpful posts how to challenge DCB legal for county court claims.  I am wondering if you'd be so kind to help me further please? 

I have a claim form where claimant UK Parking control is claiming for 3 PCN's dates: 20/05/2017, 18/11/2018 & 31/12/2019 for parking at Beckton Triangle retail park.  It says on the claim ''The PCN was issued on private land owned or managed by C.  The vehicle was parked in breach of the terms of Cs signs (the Contract), thus incurring the PCN(s)''....

I have gone through the very helpful Newbies sticky thread post and have so far responded via the steps given for moneyclaim.gov.uk & have completed the acknowledgement of service today.  The claim issue date was 14/09/2022

I have not seen any of the letters relating to these PCN's.  How best can I defend this case please? Reading through the second post on newbies thread which you wrote 26/02/2020 & edited 29/05/22,

I guess I just change point 2 to say: It is admitted that the defendant was the registered keeper of the vehicle but liability is denied. The Defendant is unable to remember if they were the driver on that day due to multiple drivers being insured and the event taking place almost 6 years ago.

Point 3- The defendant is unaware of the reasons for the 3 claims from the claimant as the defendant didn't get any PCN's or other communication from UK parking control regarding the claims.

I am intending to keep the remainder of the defence document as outlined in Newbies thread second post.

I would be extremely grateful for your support & guidance.

    With a Claim Issue Date of 14th September, and having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Monday 17th October 2022 to file your Defence.

    That's nearly four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
    To create a Defence, and then file a Defence by email, look at the second post in the NEWBIES thread.
    Don't miss the deadline for filing a Defence.

    Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.

    If you did not receive any initial paperwork from a parking company, one has to ask oneself if your V5C is up-to-date and was at the time of the alleged parking events.  Don't guess, check, as real fines (as opposed to parking company speculative invoices) can be sent from DVLA.
  • Thank you so much, @KeithP @Coupon-mad @Le_Kirk how would you advise I structure my defence, in particular parts 2 & 3 as there will be witness statements to declare in the future.  I received the threatening letters but no recollection of receiving PCN or NTK and the first PCN they reference on the county court claim is almost 6 years ago.  Thank you in advance!

    Just copy a Highview 'unremarkable day' defence.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    Are DCBL professionals ?   Clearly not.
    These claims are utter rubbish 

    DCBL really do believe they have a case but, when the srews go on, as they do with this forum, they chicken out and discontinue

    Here is one I found by searching the forum using "unremarkable day" put it in the search box and hen it returns the result click on "discussions" and change the "best match" to "Newest" and make sure you are only searching in the Parking forum (right hand side just below half way down).

  • Hi all, thanks for all your help so far with this.  I have tried to use other versions of the highview defence in my defence.  However, I don't have any correspondence from DCB at all so don't know what the total amount DCB were demanding including court costs.  Also as they are claiming three pcn's is it necessary to mention all three in my defence or is the below ok?

    So far for points 2 & 3, i've written as folllows:

    2. It is admitted that the Defendant was the registered keeper of the vehicle in question but liability is denied. The identity of the driver at the material time is unknown to the defendant. The Defendant was not the only insured driver of the vehicle in question and is unable to recall who was driving on those unremarkable days, one being over 4 years ago.

    3.   The defendant does not recall coming across any correspondence pertaining to the PCN(s) being claimed.  Through research the Defendant has come to understand that the claim relates to a PCN(s) that was issued against the Defendant’s vehicle LXXX XXX, over 5 years ago on 20 May 2017.  

    Please let me have your thoughts?
