    If your address now is different to the one the PPC obtained from the DVLA then you need to send a rectification notice to the DPO of the PPC instructing them to erase your data, replace it with your current address for service, and instruct all their agents to do the same.
    Make sure you use the word I have highlighted.
    As a precaution you should do the same with Gladstones even though the PPC should do it on your behalf.

    What about frances@ given her name is on Gladstones' claim forms, including yours I expect?

    Of course you will need to confirm your correct address and tell them to stop faffing around saying they will change it for this claim only.  If there are other cases relating to the same data subject, they MUST update the address for all.

    You will obviously also have to urgently email the CCBC to make sure they ALSO change the address on their records from that on the claim form, if that one is wrong.  If there is an old address on the claim form you can't leave anyone with the wrong address in their databases.

    So I didn't reply because I've got stuff going on at home and in all honesty forgot. I received this email today... I don't really know what to reply. I have access to the post at both houses as the one they have on their system is my parents house. So do I tell them to change it to my address, the one in acknowledgement of service, (potentially moving very soon and have actually moved back in to my parents but not "officially") or tell them to keep it as the address they've got, which is my parents, or ignore it. Absolutely no idea what the other matters are though??

    Just reply and say your parents' address (state it in full) is the best one to use for service.

    If this is the address that the courts are using too, then that's all good and it doesn't need changing.

    But if the court only has the address you are moving out of, you will obviously also have to urgently email the CCBC (and your local court copied in, because the case is being transferred there after your N180 form) to make sure they change the address on their records from that on the claim form, if that one is wrong now.  You can't leave anyone with the wrong address in their databases.

  • Hello! Thanks for all your help this far!

    I have received a letter about attending court. 
    Does this mean if they don't pay it, the case gets dismissed? But do I need to apply for the help with court fees for the last bit? I don't know what charges I've incurred or is that just for the claimant?



    It also says in the letter that the court believes that my case is suitable for mediation? Shall I ignore that? It says I have 7 days but it's already past 7 days from the date of letter due to all the postal strikes.

    Search the forum for "mediation" and you will see that the overwhelming suggestion is "NO".  If the claimant doesn't pay, they will be sent a reminder and be given more time, something that does not happens for defendants if they transgress.  Even then if it gets to it, the claimant will say "we did pay but the bureaucracy at CCBC messed up".

    Relates only to the Claimant.

    Yes but that's standard and no-one tells you if they pay or not.  Assume they will.  

    Most important to read is your witness statement & evidence deadline.
