  • Today I received the following response from the CCBC:

    ...................................

    Good afternoon,

    Thank you for your email.

Please be advised that your case has been referred to a District Judge for directions on how to proceed as the defendant's  response wasn't processed within the correct time scale.

It can take 2- 4 weeks to receive a response at which point you will be notified accordingly.

If you require any further information, please email us or contact our helpdesk on the number above.

Please accept my apologies for any inconvenience caused.

    ...................................

I called them as I need the CCJ removed urgently as I am applying for a new mortgage and it will impact my application.

They have instructed me to complete an N244 form, pay £275 and on the form request this fee to be refunded on a successful application.

That is all well and good but it still doesn't stop the CCJ.  Only paying it within 30 days prevents a CCJ.

Really?  That is not what they advised me!  He said in section 3 to state "set judgement asside" and in box 10 state my reasons.
Then once it is approved the CCJ is removed from my file.

Perfectly true, but a N244 may speed up the rectification process.
  • Sorry, so does the N244 form remove the CCJ or not please?

This is a complaint I am about to email....

    Dear CCBC Court Manager,

    This is an urgent complaint.

With regards to your email sent today, thank you for acknowledging and accepting blame for my defence being struck out and judgement being made against me.
As you know, you ignored multiple emails and did not submit my completed N180 in time.

Your error has caused a CCJ to be placed on my file.
I am in the middle of looking for a new mortgage and this will impact my applications.
I have also spent lots of time on phone calls and emails trying to get this resolved.

I have spoken to CCBC support today on the phone and have been advised to submit an N244 form and pay a fee of £275 to get the CCJ removed, which I am doing now.

Obviously, I would need this fee reimbursed and I am also seeking compensation for my time spent trying to resolve this.
Time spent so far on emails and phone calls has been 5 hours.  My hourly rate is £150 per hour so I am requesting a payment of £750.

Total reimbursement including court fees is £1025.

     Yours faithfully

    Wrong question.

What you thought was that it magically PREVENTS the CCJ showing on your credit file.

No, it doesn't.  The CCJ will land.

An application might remove it but that's AFTER the CCJ will have temporarily wrecked your credit file from this weekend onwards.  You'd take a credit rating hit for a month (assuming/hoping that your application is later agreed and that CCJ then removed).

Notice that I say 'THEN' removed.

But why would you throw £275 at it?

Paying for an application is no different than you've already (hopefully) achieved - you have been told a Judge is "reviewing it" (without an application) so unless that Judge comes back and orders you to file an application, I don't see the merit in risking £275 to achieve the same thing.

I do see merit is paying the CCJ in full to the solicitors this week under protest and telling them this is only being done to prevent a CCJ and that a Judge is reviewing clear errors made by the court that should see the CCJ order reversed within weeks.

Do not annoy the court at this crucial moment by sending another complaint (and you will NEVER get £1000 awarded).

  • Hi Coupon, sorry the last bit of your post cut off?

I do see merit is paying the CCJ in full to the solicitors this week under protest and telling them this is only   ???

Are you advising to pay BW legal in full to get the CCJ removed quicker?  And then put a claim in for the money to be refunded back to me from CCBC?

I just spoke to CCBC again and got told completely different advice, they have said the judge is already looking into it so no need to file a N244 form.

    I've now edited it.

Are you advising to pay BW legal in full to get the CCJ removed quicker?
    You're not understanding the difference:

Paying it within 30 days means NO CCJ on your record AT ALL.

Which is EXACTLY what I told you!

  • I can already see the CCJ on my account using checkmyfile.com.

I know what you told me, I am just letting you know what the second advisor said.

The CCJ technically exists but will disappear if paid within 30 days and will leave no trace.  That is the important point.
