    Looking back at the newbie thread, I don't have to do anything until I get the hearing date and can just ignore the recent letter I have received? 

    With regards to the defence that BW legal are saying is mostly irrelevant, I copied the whole template on this forum and edited #2 and #3 as advised.

    There's a few more steps before you get a hearing date.

    The next thing likely to happen is a County Court Claim Form dropping through your letterbox.
    When that happens, post again on this thread telling us the issue date on it and more guidance will be forthcoming.

    This poster is already at claim stage and past defence, I think.

    i have now received the attached letter but I’m confused why it states ‘as there is no defence to our clients claim’ when I submitted my defence weeks ago?

    What do I need to do now?  Any advise is much appreciated, thank you

    The opening sentence of that letter should be of concern...


    What can you tell us about this?
    Has the court struck out your Defence?
    If your Defence has been struck out then the CCBC will have informed you of that.

    If you know nothing about this then you need to find out from the CCBC exactly what is going on.

    What does your MCOL history tell you about the receipt (or otherwise) of your Defence by the CCBC?

  • I submitted my defence on 30/08/22 by email and had the confirmation it was received.
    I sent the questionnaire on 31/10/22 but then got an email on 08/11/22 saying they were returning the paperwork back to me because page 3 of the 4 pages was missing.
    I then sent page 3 again on the 08/11/22.


    I have just checked MCOL and have the following:

    - General sanctions order was made on 27/10/2022
    - Your defence was rejected on 15/11/2022
    - Defence was struck out on 15/11/2022


    Do you think it was caused from page 3 of the questionnaire being missing? 

    Is this too late to resolve now it has been 'struck out' and should I pay up?

    No - the CCBC has screwed up.

    You MUST MAKE A FORMAL COMPLAINT to the CCBC pointing out (and proving) that you did send back all pages of the DQ.

    State that the Order to strike out the defence is in error and you require that your proof that you did return the N180 on 8/11/2022 is placed before a Judge and the court manager as a formal complaint.  The Defence must be reinstated.

    Dear Sir or Madam

     I would like to make a formal complaint for my defence being struck out in error.

     My defence was rejected and struck out on the 15/11/22 for reasons unclear.
