  • This is what I got back:

    Mortgagees require minimum of 5 working days notice

     We can only order funds once exchange has taken place

     Your buyers also need to order mortgage funds

     If we do not exchange tomorrow there wont be enough time for everyone to request their mortgage funds

     I need to go there tonight which will cost me time (it is unfortunately 2.5h away from where I live) and money but apparently there is no other way.

    I am stunned this has happened.

    This is nonsense, like I said above.

    And in practice most lenders can work with far less than 5 working days' notice anyway - that's just the worst-case scenario.

    We have travelled yesterday to deliver the remaining document and our solicitor said today they will not be able to exchange because the seller's solicitor has not delivered all necessary documents.

    It's just beyond me how my solicitor can say that they are aiming for exchange pending the last document from us is delivered by midday today and fail to mention that they are still awaiting some documents from the seller's solicitor.

    Is this the norm to inform your client everything is ready for exchange and fail to mention explicitly that it just from our side ready for exchange but not from all parties?

    We would not have taken time off work yesterday to travel to drop the signed documents (few hours one way) if we were told they have not heard back from the seller's solicitor. Yes, we could have opted for local solicitors but that is not the point here.

    It is also obvious we as clients would not be calling all other parts of the chain to confirm the exchange in order to organise our house move but would expect this to be explicitly explained to us by our solicitor. Otherwise it is just a guess game for a client to come up with what the solicitor actually may mean by saying we will be ready for exchange.

    The client of said solicitor (us) is not interested about partial readiness for exchange but wants to know the full picture without any guess work needed at his/her side.

    Am I just mad thinking my solicitor provides a very poor service or is it a norm these days?
