Minster Baywatch Ltd Claim Issued through Gladstones Solicitors LTD - CASE DISMISSED!!

Hi everyone,

The keeper of the vehicle has received a Claim Form from Gladstones Solicitors Limited for their client Minster Baywatch LTD. The date of the claim is 08 August 2022 and they are claiming:
  • Amount claimed £157.69
  • Court fee            £35.00
  • Legal rep costs  £50
  • Total amount      £242.69
The keeper has read #2 of the NEWBIES post.

Supposedly, the vehicle parked on 10 April 2022 at Cotswold by the driver at Lakeside Car Park, GL7 5LU from 16:59:00 to 17:52:06.

A 1st letter for "Notice to keeper or hire company " was sent on the 20th of April 2022 for the usual demand to pay £60 within 14 days or £100 for the next 14 days.
A 2nd one for "Demand for payment of unpaid charge" was sent on the 20th of April 2022 for payment of £155.

Both were ignored by the keeper.

A "Letter Before Claim" (LBC) was sent by Gladstones Solicitor on the 10th of June 2022 for a payment of £155.
This was ignored too because of a lack of information to fight.

A SAR was sent to the PPC on 16 August 2022 with a bill as ID but they came back and ask for other IDs like driver's license, passport etc... The keeper has consequently provided 2 utility bills on 19 August 2022.

Questions:

The day of service is13 Aug 2022 right?
The keeper has until the 27th of August to start AOS?
I guess it's too late to send the letter to the solicitor, as they have already given 30 days to respond, right?

The keeper will probably have more questions later.

The keeper is starting its defense by reading the template.

    Are you the keeper? Perhaps you should read it too, as you've posted in the wrong place! Ask a mod to move it to the parking sub-forum.

    No court filing deadline will be on a Saturday, Sunday or Bank Holiday.

    With a Claim Issue Date of 8th August, you have until Tuesday 30th August to file an Acknowledgment of Service but there is nothing to be gained by delaying it. 
    To file an Acknowledgment of Service, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.

    Having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Monday 12th September 2022 to file your Defence.
    That's three weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
    To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service instructions.
    Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.

    Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.

    What exactly did you ask for?

    I'd be asking them who Bransby Wilson are (even though we know who they are) and what is their involvement in this?

    Who passed your personal details to BW and on what authority?

    Why were those details passed?

    Why are BW holding your personal details, and for what specific purpose?
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Reply and say - but those payment records were shared with you and linked to the system.  Am I wrong? You must have some sort of record otherwise how did your system issue an automated PCN?  Please supply your 'PCN History' from your system because that includes my data, and a copy of the info you were supplied with by Bransby Wilson regarding the alleged non-payment or any VRM typo or lookup.
