No ticket or notice, only debt recovery letters

Hoping for some help and support please.

We have just received 2 x Debt Recovery Plus letters (dated 27/07/22 & 08/08/22) relating to an alleged £170 parking charge from JD Parking Consultants Ltd, dated 04/05/22.

There has not been any window ticket, or any postal Parking Charge Notice received, or any correspondence from JD Parking.

This is the first notice we have of the parking charge, and they were sent to an old address. The car is a lease hire. Both DVLA & lease co were informed of change of address, but assume may well have crossed in meantime.

Reason for issue stated: Parked in a permit only parking area without clearly displaying a valid permit.

Unfortunately the website shown for JD Parking Consultants (jdparking.co.uk) on BPA site won’t load, but we have located their registered office address via Companies House. [N.B. Not to be confused with JD Parking Solutions, who are IPC registered].

We will ignore the debt recovery letters, as advised and have drafted an appeal, but should we try and contact JD Parking Consultants direct and if no response try BPA, go straight to BPA direct for contact details now, or even ignore it?

We’re assuming DVLA has given the lease co as registered keeper, who in turn have provided our details. Do we need to confirm who and when DVLA gave details (and can we even do that as a lease car owner)?

In the circumstances do we accept the DRP letter as our 1st notice to keeper?

Signage is clearly a concern (if we didn’t see it) and we’ll return to try and locate and photograph details.

Also can there be a breach of contract, if it was permit only parking? We do not yet know the landowner, though assume this relates to residential parking, when viewing a new property.

    Not much you can do now debt collectors are involved, they can't do anything other than send you silly letters, so ignore them, do not contact them. 

    You need to see if there is any further move by JD Parking, then tackle that, with forum advice and guidance. 

    Unless you can get the landowner to cancel the charge, you've got to ride this out - 6 years, I'm afraid. JD Parking are not noted for being particularly litigious. 
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    First point is to ignore DRP. They are simply circus clowns with no clout.
    DRP have added the fake £70 because the BPA approved the money scam in their code of practice.  It's all total rubbish with no legal authority, just cloud dreaming junk

    You now send a SAR to the PPC who should provide a copy of the ticket and info they have on you

    You need to take a photo of the sign and post it on here

    BUT DRP ..... the biggest joke and money scammer around

    I presume if we SAR JD Parking Consultants, they will know we have responded.

    We just wish to do the right thing, so are nervous of the ‘wait 6 years and see’ approach.

    You MUST do that and tell their DPO to rectify the address as well.  It's really just to say 'look, I'm here and you were given the wrong address for me by the lease firm so put it right'.

    Really necessary - because you need to see all letters in future and you need JD not to think about trying to revert to the lease firm, pretending you don't exist.

    After that, IGNORE (but don't ignore a claim).

    You COULD try asking for a POPLA code as well, on the basis that the new incoming statutory Code of Practice that (for the main part) PPCs have been urged by the BPA to observe already, says if a new address is discovered then the Notice should be re-issued at the original rate and the consumer allowed to appeal. Don't hold your breath!

    Thank you Coupon-mad that’s really helpful.

    I’ve located JD’s registration certificate from the ICO website, so will write to the DPO at that address, with SAR and stating correct postal address. There is no individual listed, nor email address, so presume will have to send by post.

    I’ll also try for a POPLA code. Should we bother with any appeal correspondence at this stage, or just simply ask for the POPLA?

    Just say at the end of your email (WITHOUT IMPLYING WHO WAS DRIVING) that the signs are pants so you want a POPLA code to appeal, and point them to the incoming DLUHC CoP that is unaffected by the Judicial Reviews and says that where a new address is discovered...blah blah...

    This is the sign on-site. Seems to show Parking CSL for payments and appeals, with enforcement by JD Consultants. Assume it’s still JD we need to contact with SAR or do we also SAR CSL now too, as unclear who ‘contract’ would be with? Still to identify landowner.

    DRP/CSL are the back office firm who obtain the dvla data etc

    When contacting the PPC's DPO with the rectification notice, instruct them to erase your old data and replace it with your current address for service. Make sure you use the word I have highlighted.
