PCN - not parked in bay correctly

Comments

  • How about parking properly, a little further away, and walking? In retail parks I tend to park as far away as possible, the little walk does me good.

Interesting comment with lots of prejudgement. You assume everybody has your mobility.

My wife used to be a blue badge holder due to hip mobility issues. She gave it up as she felt she didn’t want to be taking up spaces of others more deserving. She has good and bad days. This was a bad day . As such we tried to park closer to the store but these were the only bays free.

At all times I have used the word We rather than I and I’ve never stated how many people were in the car.

Include that in the POPLA Appeal even though they don't consider mitigation. Worth stating.

  • To be honest Coupon my wife just wants to pay it which I may end up doing just for an easy life.

I appealed on day 15 as we go away soon . The price had gone to £100. If I offer to pay the £60 how much are they likely to fight for the extra £40. Surely a court wouldn’t be impressed that I’d made a reasonable offer which they rejected.

Day 14 was a Sunday and on day 15 a document from my bank arrived showing the time of my transaction in the store . I used this for my appeal.

What if I didn’t deny the debt but offered to pay over 2 or 3 months? I just want to make them wait for it

    Nonono.

    That's giving into a scam.

Why?  What are you scared of? You'll pay nothing in the end.  And maybe they will not send a NTK so it will be an easy win at POPLA.

It's a no-brainer. You can't pay £60 so let it play out.  There is nothing to be frightened about.

For people who say they 'want to pay for an easy life' I posted this yesterday and I'm just an ordinary middle aged woman, maybe like your wife:

  • Thanks Coupon. I understand your passion and I agree with you. Perhaps we don’t have your confidence .

I’ll see how we get on and keep you updated on here . A lot is to do with other issues in our lives and whether we could be bothered with the stress of it hanging over us.

I suppose that’s what the parking companies play on.

Just had my appeal decision received from UKPC and they have cancelled the ticket based on the information I supplied.

    Wasn’t expected but delighted.
Well done, nice one. Did you use the blue text initial appeal template from the NEWBIES FAQ Announcement, or one you constructed yourself?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

  • Just one I constructed myself.

I can only assume that they have interpreted the 10 minute grace period in the same way I did . If I’d failed in this appeal I would have used the templates for POPLA but only came here after I’d already appealed .
