    Out of interest, how long did the judge give you to speak?

    Watch this space, lets see if they issue a court claim for the 3rd "pcn" for identical exact same particulars at this carpark.

    But, presumably, not all the various points you originally had listed in your crib sheet?  Good that you concentrated on the signage, not distracted by attempting to argue the landowner contract angle. 

    We need to build a picture of what happens in court so we can give the most accurate and contemporaneous advice to others who will follow the same path as you in the future.

    Spot on, it was based purley on facts, inadequate signage in the dark in an old unlit carpark, sign hidden and if any not visible on their WS and impossible to be visible to a driver not to mention upon entry sign "if any at the time" was obstructed by parked cars at the gate.

    If you have another PCN for essentially the same POC in the same car park, you should be able to use cause of action estoppel - Henderson v Henderson

  • "The case was based on the fact that this carpark company are making claims suggesting their stock photo and photo exhibits in their WS were the exact signage at the time in the carpark. The images that the claimant produced in their own WS were going back almost 7 years. The carpark did not have adequate lighting, it was at night time, and not able to form a contract by these facts. The claimant was pressing that his client had signage but the facts say different and that is the end of the matter. Case dismissed."

    Well done on your win  :)  PPC's do this often. The car parks are photographed empty and newly painted. In reality on a busy day you can't always see the siignage.

    Hi Everyone,

    Another twist in the tale.... I just seen this letter and it was dated 16th Jan and Most likely landed through the letter box on the 18th-19th Jan.. By that point my WS was already submitted.


    Well it looks like UKPC has 3 PCNs for this particular carpark, Jack straws castle. In total all 3 PCNs are 14 days apart. This letter is for a pcn 5 days after the x2 relating to this thread.


    Why did UKPC not do this as a single claim as all the particulars are the same, same carpark, same vehicle, same driver. They are timing the chain letters at different stages to generate more revenue.

    Hope everyone is doing well. As predicted a claims form arrived today from County court business centre for this case. 

    Same particulars, same location, same carpark, vehicle etc.. different date to the last 2 (2 weeks after). This is pcn 3 out of 3. The previous pcn1 and 2 were consolidated into 1 court claim which I won.

    Address for sending documents and payment
    DCB Legal Ltd 
    Amount claimed £220
    Total Amount £305.40  

    Rather than creating a new thread I will keep it on this thread as all the particulars are identical. I have the claim number.
