Chrome020 said:Any advice here? My previous employer isn't replying to HMRC and they aren't replying to my emails either, I have requested mandatory reconsideration but what's the chances of me getting anywhere if my previous employer just ignores any requests. This is what happens with an RTI dispute - HMRC make one attempt to contact the employer and throw it back to DWP (UC) if they do not respond within 24h. As the employer is lawfully bound to report accurately and on time, they will go with what has been reported to HMRC.Apologies, as I've not followed the whole thread, but if your employer has reported earnings that you say you have not received, you will need to provide proof that you have not received them (or have received something different to what HMRC show). That can be payslips and/or bank statements. Generally though, it's not easy to prove that you have not received something (by definition there is no proof, only a lack thereof, unless you have a payslip for the period showing zero) - far easier to prove you received a different amount to that stated.

Thank you for your reply. This is what I don't understand as on the PAYE GOV website it says minus £20.50 for the 29th of July. My last pay from them was the 1st of July at £773 but the statement ran from the 9th of July so It can't be including the 1st. I will send my payslip if they allow me to, the payslip says zero after they took the deduction for what I owed them.NedS said:Chrome020 said:Any advice here? I would ask to book an appointment at the jobcentre to discuss. Take in your payslips and bank statements (the ones showing previous salary payments and the latest statements showing no payments went in after you claimed UC. Can you also show them your HMRC account on your phone and compare it with their RTI feed - your HMRC account will only show the date you were paid whereas their RTI feed has the date you were paid AND the date the information was reported by the employer to HMRC. See if the employer was late reporting, and reported the earnings AFTER the date you made your claim. You need to convince them that you received those final earnings on 1/7/2022, and not after the date you made your claim.

Chrome020 said:Hi, hoping someone can clear up what I'm going through with universal credit at the moment.
I left my previous employer at the end of June 22 and received my last full pay on the 1st of July, I signed up to universal credit on the 9th of July and so the universal credit statement ran from the 9th of July to the 8th of August. I was supposed to be paid a small amount of pay from my previous employer on the 29th of July but as I owed them holidays I received no pay at all. I received my universal credit statement on the 9th of August and it said I'm due to £0 on the next pay date as my employer reported I earned £752 from them in the universal credit assessment dates of 9th july-8th August. I haven't received a single penny from my old employer since my 1st of July payment. Staff at universal credit have ran a PAYE check and it says it was reported I was paid when I wasn't. Am I missing something here? I'm worried as I won't receive a full pay from my new employer until late September due to the way their pay cut offs work. My next pay at the end of August will only be around £220.Could that amount have been £752?The only thing I can think is that they have paid you £752 and then deducted it back as owed holidays, thus you've received zero but were actually paid £752.If that's the case, then what they have done is correct. Either way, it should show on your payslip. What pay does your payslip show for the period BEFORE deductions? Does it show £752 and then deductions for owed holiday taking it back again?

Thanks for getting back to me, I have inserted a portion of that payslip just with the earnings details.NedS said:Chrome020 said:Hi, hoping someone can clear up what I'm going through with universal credit at the moment.

I only worked 3 days in the new period for the 29th of July payday.
I took 2 weeks in may so it wouldn't have been over 700 owed back, I'm not sure on the total I would have owed them as I would have accrued some days from working til my last shift.
To me it looks like they have used my 1st July earnings minus the £20.50 over payment that's reported on my PAYE account for the 29th paydate.
1st July 773.06
- 20.50
=752.56 which is what is on my Universal credit statement.

Bingo! If the numbers add up, this will be it for sure. And this should be easy for you to prove, because (a) DWP's own RTI feed will show the date the employer reported (almost certainly on or after your claim date of 9th July), and (b) you can show your payslip and bank statement showing the pay date as 1st July, before you made your claim.Chrome020 said:
Hi. This is what I think too, even though my previous employer has said 1st of July was reported on time.Icequeen1 said:
It is possible the payment on 1 July was reported late and so fell into the same period as 29 July payment which was netted off against it? Not quite £752 though.Chrome020 said:UC just rang me not long ago and asked again when I was last paid which I explained again for the 100th time, then they said it's because of the 3rd of June payment was reported late in mid July but I don't see how it's that as it's reported I was paid 752 this statement not 677? Think they've lost the plot just as much as I have with this.
Anyway, they have put in an investigation but I most likely won't hear back til next week now and the gentleman said if they get the exact same figures back that they already have I will have to provide payslips and bank statements which I'm happy to do.
My 1st July pay was £773.06 and they said for the 29th of July there was a £20.50 adjustment 773.06 - 20.50 is 752.56 which is the amount reported on my UC

The only other thing you could possibly do to confirm is phone HMRC (if you have plenty of time on your hands to get through) and get confirmation from them of what date the employer reported. The date that is relevant for UC is the date that DWP receive the info from HMRC system. Good luck!Chrome020 said:

Waited for ages and they couldn't help, the daft automated system put me through to tax credits and the advisor just asked me to contact my previous employer again. Would be nice but they are ignoring my requests.Icequeen1 said:
