Read Excel v Greenwood and the press article about it linked in the thread. Is your Dad a similar age? Forgetfulness is common due to old age and the stress of attending an appointment, even if he doesn't have MS like Mr Greenwood.

Thank you for this, my dad is 77 so quite a bit older than Mr Greenwood was at the time of his case. so I think I will add this is in to his defence as suggested.

My dad has just called me to say he has received a letter from the health trust to confirm that they cannot intervene. I will be picking the letter up later and will post it on here. Seemingly not much compassion for a health trust. Very disappointed in their attitude as they seem to be fine with the conduct of the PPC

    NHS parking principles?

Seemingly not? VCS have also told them that my dad didn’t pursue it any further, which is a lie. At every stage including the kangaroo court that is the IAS it has been chased and they have been told of the disability. What is wrong with these people? Interesting that their tagline line is promoting health and well-being

Thank you Half_way, that did make me smile. Definitely no love lost though  The only thing I am not entirely sure they will agree with is that they are an NHS trust, although I would say that even if they don’t have  NHS in their name, they do operate sites that provide NHS services.

Even if they are not an NHS trust, they will still be jointly and severally liable for the actions of their agents - and this would include any breach of the eqaulity act, GDPR and so on .

So even then the unable to intervene paragraph in the letter is complete nonsense.

Appropriate guidelines could still be the NHS guidelines in a healthcare setting

I think treat a 'Healthcare' Trust as an NHS Trust.  They still have to abide by the Equality Act.
