My dad has just called me to say he has received a letter from the health trust to confirm that they cannot intervene. I will be picking the letter up later and will post it on here. Seemingly not much compassion for a health trust. Very disappointed in their attitude as they seem to be fine with the conduct of the PPC2

Hi mechpet My wife has been in a similar situation and the parking sharks dropped the case at the last minute 2 days before due in court. Lots of threats and reduced penalties but following advice on here we stuck out and would have gone to court.
Follow advice on here given by experienced regulars and you will not loose!
Please complain to everyone you can and have you contacted the local press?

Something like - but not the same as this - its just an idea on where to go with the NHS trust head in the sand r soles.To whom it may concern at xxx healthcare trust.I am in receipt of your letter and its contents have been noted.As someone with a protected characteristic your agents, VCS should have dropped the parking charge notice against myself as soon as they became aware of my disability / requirements for reasonable adjustments under the Equality act .However no such action has been taken, instead they have aggressively pursued me over this matter.You also state they have a process in place that adheres to relevant guidelines, and you also state that you are unable to intervene further, this appears to be far from the truth.The NHS parking principles are quite clear on the "guidelines" and these clearly state under contracted out parking that :
- NHS organisations are responsible for the actions of private contractors who run car parks on their behalf.
- NHS organisations should act against rogue contractors in line with the relevant codes of practice where applicable.
- Contracts should not be let on any basis that incentivises additional charges, for example ‘income from parking charge notices only’.
You said that HHCT are unable to intervene, this is in direct contravention of these guidelines that you say you followthe Guidelines also state that NHS organisations should act against rogue operators , VCS are an un regulated predatory company who source their income form issuing parking charge notices and aggressively chase people, using and abusing the court system to achieve their ends.There is no true independent appeal available as the individuals behind the trade association (IPC) are the same as those behind the so called appeals service and even the solicitors usedThe IPC/IAs/VCS/Excell appear to be the very definition of "rogue contractors"I trust i have your understanding on this, and you will ensure that the parking charge notice issued by your agents - for whom you are responsible for will be cancelled with immediate effect, you will take measure to ensure that this does not happen to a vulnerable/disabled person again, and issue a full and un redacted apology over the NHS trusts breach of the equality act.I look forward to your response and confirmation that you have taken the action neededLots of love, hugs and kisses, MechpetFrom the Plain Language Commission:

The only thing I am not entirely sure they will agree with is that they are an NHS trust, although I would say that even if they don’t have NHS in their name, they do operate sites that provide NHS services.

Even if they are not an NHS trust, they will still be jointly and severally liable for the actions of their agents - and this would include any breach of the eqaulity act, GDPR and so on .So even then the unable to intervene paragraph in the letter is complete nonsense.Appropriate guidelines could still be the NHS guidelines in a healthcare settingFrom the Plain Language Commission:

I think treat a 'Healthcare' Trust as an NHS Trust. They still have to abide by the Equality Act.Did you see this one I wrote last week, that worked?
