Great result. Red meat for the forum regulars! 🥩
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

I bet BW won't be putting this in their news section.

Doubt it but does not matter really, all MSE threads go onto google so everybody can see the spankings of BWLegal and all the other daft legals

Today I won my dispute with bwlegal (representing KBT Cornwall t/as Armtrac Security Services - !!!!!!) where I was taken to court for the non-display of a car parking ticket in August 2020 at Swanpool car park, Falmouth in Cornwall. The case was decided at a telephone hearing this morning hosted by the County Court at Worcester. I made 5 points in my defence - the judge never got past my first point before deciding against the claimant and striking out the case. Not only was 'unreasonable behaviour' cited against bwlegal (they never turned up and were represented by an adjudicator), but I I was also awarded total costs of £387.50.
A shout out to !!!!!! and bwlegal for their totally unreasonable behaviour throughout. They are both morally bankrupt.
What was/is an adjudicator and are they even allowed to participate in court proceedings?
bwlegal didn't turn up at the telephone hearing, they must have paid someone who was introduced as an 'adjudicator' to represent them. The judge asked them early on if they had the power to act on behalf of the client.

Frappy5, could you divulge details of the curcumstances as I am currently awaiting adjudication by the IAS for a "non-display" situation last month at Swanpool - I used JustPark & the app messed up the (correctly entered) VRM - although I had paid the tariff & Armtrac's own "evidence" proves that I paid! Any info much appreciated, cheers!
I purchased a ticket and it fell off the windscreen. Photographic evidence I took proved I had displayed the ticket, but it fell face down. The judge ruled that it was not in dispute that I purchased a ticket, and I had evidence that it was displayed and asked why would KBT Cornwall t/as Armtrac Security Services and bwlegal pursue this. It sounds like you have a similar situation albeit digitally. If Armtrac's 'evidence' in your case supports the fact you paid, it is clear to any reasonable person that it would not be in the public interest to penalise a person who paid the required fee, has evidence of doing so and has done nothing to the detriment of public interest.

Or was he perhaps introduced as an advocate?
Possibly - I was pretty nervous at the start so probably didn't register...

Well done .... the "rent by the hour" legal did not turn up, what a laugh

By the way you said .. "The judge asked them early on if they had the power to act on behalf of the client."  who was he talking to ?

Just another day in the office of a robo claimer.... BWLegal.
    They failed their client
Armtrac Security Services ?  GOOD ?

Another thread which can be seen on google search
    :s

These legals seem to have no idea the damage they do to themselves by getting involved in the great parking scam for monopoly money
