Court case won v KBT Cornwall trading as Armtrac Security Services and represented by bwlegal

Today I won my dispute with bwlegal (representing KBT Cornwall t/as Armtrac Security Services - !!!!!!) where I was taken to court for the non-display of a car parking ticket in August 2020 at Swanpool car park, Falmouth in Cornwall. The case was decided at a telephone hearing this morning hosted by the County Court at Worcester. I made 5 points in my defence - the judge never got past my first point before deciding against the claimant and striking out the case. Not only was 'unreasonable behaviour' cited against bwlegal (they never turned up and were represented by an adjudicator), but I I was also awarded total costs of £387.50.
A shout out to !!!!!! and bwlegal for their totally unreasonable behaviour throughout. They are both morally bankrupt.

What was/is an adjudicator and are they even allowed to participate in court proceedings?

Costs of £387.50 AWARDED TO YOU ... that is a good one

BWLegal should stop taking these rubbish cases to court.

Three hours were allocated to this hearing. That is going to to be costly.

@lakefire have you found the other sennen car park threads on here? we had a cracking case recently where it was established the ticket machine instructions were wrong - the photos are here just search the forum and perhaps start your own thread.

BBC WatchDog “if you are struggling with an unfair parking charge do get in touch”

Please email your PCN story to watchdog@bbc.co.uk they want to hear about it.
Please then tell us here that you have done so.

  • Frappy5, could you divulge details of the curcumstances as I am currently awaiting adjudication by the IAS for a "non-display" situation last month at Swanpool - I used JustPark & the app messed up the (correctly entered) VRM - although I had paid the tariff & Armtrac's own "evidence" proves that I paid! Any info much appreciated, cheers!
