The LAs have the option to remove their PPO, so can legitimately opt out of the TMA.
You are mistaken. That is covered in the Robert Goodwill letter. They cannot opt out of the TMA.
Now that's interesting. Some years ago, my local council brought in CEL and ANPR to monitor the council owned car park at their sports centre. The car park was subject to a PPO. I pointed this out to them, and they stopped enforcement until such time that the removed it from the PPO.
Are they acting unlawfully? The reasoning that they use is that they lease the whole place (sports centre and car park) to a private company who run the sports centre. (Running council sports centres is a business carried out by a number of private companies.) Does the fact that it's leased out make a difference, or is it still effectively council land that must not be patrolled by ANPR? (Incidentally the signage says "private land" which isn't true.)
