As mentioned above I won this case today and here are the details
I attended Manchester Court today. Something I was not expecting was the security checks going in like at the airport and also I was taken into a proper courtroom room not an office type room I thought! The judge was on the stand at the top and we were underneath.The solicitor tried and pushed very hard that by entering the area there are multiple signs everywhere and I had entered into a contract!
Rather than trying to overcomplicate things I stuck with having a sneezing fit is not preplanned and I put the safety of other road users first by pulling over for 9 seconds and also the section I pulled up in did not have any lines red or yellow and the photo evidence shows this as well as their sign behind my vehicle. The solicitor did try on several occasions to make a deal to lower the price to pay, which I refused.
Their solicitor then pulled out x2 multi-page documents with example cases that have been won by the company from vehicles entering the contracted area and stopping. The judge was not happy that I have not been provided with these details before and asked us both to wait outside whilst she read the documents. We waited outside and the solicitor tried to show me the detail. I had a quick skim over but was far too much to take in under the circumstances.We were called back I and the judge asked if I had read the papers. I explain I had not and I also shown her the paper which clearly stated all papers had to be submitted by 29th June and giving these to me at last minute is unfair to expect me to read and understand them today.The judge made it clear she was not happy about the new papers and that there were differences to what was submitted originally, she told us that the example won cases he produced and was the basis of his claim was not relevant to this case and she said therefore there is no case to be upheld and I won!
Could not have done this without everyone on here’s support, time and dedication to these bullying companies. They are intimidating and it has taken a lot of time and energy but was it worth it - yes! And it wasn't for your support I would have easily called it quits and paid them25 -

Yes @lissylou; you're feeling fantastic; let's hope the claimants are feeling at least OK. Someone on the prosecuting end could learn at least something. Was it Einstein who said that one definition of madness is to keep doing the same thing over and over but to expect a different result? No doubt the JR will see thoughtful, even chastened, reps from the PPCs who have seen the light and want only a fair and sensible service. @Coupon-mad will be able to advise as she (and I think @bargepole too) sit on the government select committees representing the public. If you got awarded any costs then Gladstones will be in touch to pay you. And the court will send a short confirmation Order out dismissing the claim.
Do stick around for one more big battle though, please!
I expect you are still angry about this pathetic waste of time PCN claim and the scary threats and intimidation of court being used as a cheap form of frightening 'debt collection' to make victims come to heel.
These claims are unnecessary, extortionate and disproportionate and it's the £70 enhancement lie that actually funds the 'court claim race' that must be stopped.
Please get your own back by coming back here and responding to the Government's Final Public Consultation on the level of parking charges (and the added false DRA fee) later this year.
