    I never saw your address.
But as I said earlier, and I now repeat... your full name is still showing.
  • I have received the N180 form and filling it in now.  I have chosen my local county court and I have no witnesses.

BW legal must assume they will win this case otherwise why would they bother pursuing it wasting their time going to court?

No, at every stage some people will give up the challenge and pay.

On receiving an initial Parking Charge Notice, some people will pay.

Of those left, they will appeal and when the appeal is refused, some people will pay.

Of those left, they will file a second level appeal and when that is refused, some people will pay.

Of those left, when they receive threatening debt collectors letters, some people will pay.

Of those left, when they receive a Court Claim, some people will pay.

Of those left, some people will give up the fight and pay when they realise the effort involved.

    It's a numbers game.
  • So when I go to court, I go in suited and booted and say good morning or good afternoon to the judge.
Then he reads the defence you guys kindly helped me with and tells the parasites to leave me alone with nothing to pay?

You you will get notification of the court hearing in due course which will give a date and time by which your witness statement  (WS) must be submitted which supports the defence you have submitted. You can cut and paste using the format and detail from recent cases to suit your specific case. Two of them are posted in the threads  by aphex007 and Daiapolon2021

    Hopefully.
But obviously defence is not your only submission...

If you think you have no witnesses and that defence is the only document the Judge needs from you, then you are currently going way off piste from the step by step KNOW WHAT HAPPENS WHEN instructions in the NEWBIES thread.

  • Hi

The court hearing is on 9th of August, but I have received the attached letter from the court saying it will be a block hearing list.
They want me to be there the whole day, and cannot even promise the case will be heard!

I am self employed and cannot afford to take a full day off work knowing it might not even get heard on the day.

I need to look up the next steps on submitting evidence from the newbies thread, can I fight this without attending court?

I wonder if the Claimant might discontinue because of the expense of sending someone there all day.

Is it a single PCN case?

Is your deadline for WS & evidence this Weds?

    Remind us about your case.

Don't let on YET that you might not attend, not this coming week anyway.

I suggest you start preparing your WS bundle based on the one by @aphex007 and show us your draft tomorrow if you can.

When I had my court hearing a had jeans and a jumper on, VCS sent their own legal person in and was suited up, lap top at the ready and came out with bile about the legalities about parking abuse, the kind woman judge asked if I wanted to make a comment and I spoke dor about 10 minutes outlining everything about that day and how unfortunate I was to be at court - the judge totally agreed and sided with me, the VCS rep asked for an Appeal and the judge denied it and even told him to stop wasting their time on matters like this.

My second court case with Highview got withdrawn right at the last minute so didn't have to attend .

Thanks to the team on here I got through it and it was quite hard if you don't know anything about the law stuff but I learnt quite a bit from reading too.

It's amazing how they scare people and people give in and pay up.
