Yup, looks good to me. Simple, clear and to the point. No grace period given for you to pay, you can add that oberservation at witness statement stage.

  • Hello everyone

So I submitted my defence on 8th of August and received the confirmation email from the CCBC.

But to date I have not received any questionnaire which the guide on this website says I would?
Do I just sit and wait for it or shall I download one and send it to them?

    Thanks for your help

You only get that once the claimant has confirmed to the CCBC they wish to proceed with their claim after having read your defence for which they have 28 days to do so.

When did the claimant receive your defence, when did the claimant read your defence, when did the claimant confirm to the CCBC that they wish to proceed ....... ???
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

  • Hi Umkomaas

On the 5th of August you said only to email my defence to the CCBC and not to the claimant which is all I have done.
Therefore, I do not know if the CCBC has forwarded my defence to the claimant or not, if they have read it and if they wish to proceed?

Nope, but that is standard procedure and takes more than a mere week.

    That's fine.

The CCBC will send you a letter, saying that they have sent the Claimant a copy of your Defence and the Claimant has twenty eight days to consider it.
What you don't know is when the CCBC sent a copy of your Defence to the Claimant.
It follows from that that it is not known when the Claimant has to respond to the CCBC.
Further, we don't know what delays there are in the CCBC that means they don't send you a Directions Questionnaire as promptly as you might like.
Can I suggest that you keep checking your MCOL Claim History and as soon as you see that the CCBC has sent a DQ to you, you are ready to download a DQ, complete it and fire it back to the CCBC, remembering to send a copy to the Claimant of course?
  • Ok will do, thank you Keith

I still have not yet received the questionnaire but today I received this letter. Do I need to do anything yet or ball still in their court?
Thank you for all your help so far!

You've left your full name clearly visible on that image.

Does this extract from that check list you were following when you filed your Defence help?...
