DCBLegal/UKPC letter of claim from 5 years ago

OK. My old flat/apartment had a communal parking area which had designated parking spots for each resident. Around 2016 a private traffic parking charge company steps in and starts monitoring the area. If we had gotten our parking permit, all would've been well and good, but because I was renting out the place and didn't own the flat, my permit had gone to my landlord. By the time my permit arrived, I had acquired around 3-4 parking charges all for the same reason, "Parked in a permit area wothout displaying a valid permit". Now of course I appealed, and I remember 1 or 2 of them got revoked.

Last year, I recieved a letter from the parking companies legal team about a letter of claim and paid it as I did not want to go to court. I remember calling the parking company at the time and asking why they would cancel some but not all parking charges if they were all given for the same reason and ther response was that "they don't know".

Today I recieve another one of these Letter of Claim. Now, I had got the parking charge on 21/12/2016 and I appealed in early 2017. I can find no trace of a response to this appeal I made. All I can find is an automated response saying

"Your charge will be placed on hold whilst under appeal and we will aim to respond to you by formal letter/e-mail to the address supplied within 35 days, should you not receive a response within this time, please contact our information line on xxx."

Now, how can I approach this situation. I have tried calling the parking company but they wont pick up.their legal team won't do anything about it. Should I ask for a SAR to the parking company? A CPR to the legal companyl? By the way I still have my permit today, if that helps at all.

I am trying to either take it to court or drag it out 6 months more. Do I have a good foundation to be able to win a court case? Or how can I extend the time so I can reach the 6 year deadline. What should I ask from them first. Thanks!

  • I have filed a SAR to UKPC today and notified dcblegal of that too. My main aim is to drag out the process till December so the case officially goes past the 6 year deadline which results in them not being able to pursue this charge anymore. What would be the next logical step from here to drag it out for a further 3-4 months. I am looking to use the "i am seeking debt collection advice" around a month before the deadline allowing the PCN to run out of time.

          - A list of all PCNs outstanding against me.
          - ALL PCNs which were cancelled
          - ALL telephone recordings from my numbers xxxx and/or xxxx.
          

    If you need any more data from me to confirm my identity please let me know. It may be helpful for you to know that data protection law requires you to respond to a request for data within one calendar month.

    Don't offer them that, it will allow them the opportunity to drag this out. Simply send them a copy of your V5C (logbook) and a redacted utility bill, or a copy of other correspondence sent by them to you.

    This is so winnable - I mean you have a rock solid defence. Pity you paid one not wanting to go to court.

    I am battling the same for my son, your lease overrides anything the PPC's signs say full stop. Keep us updated and we can guide you to victory, don't worry about court

    Exactly right.  Keep that till last.

    All you can do in between is ask questions and if they mislead you or refuse to provide something, or are unreasonable, report DCBLegal to the CSA and DVLA to hold the process up and make it difficult.

    The problem DCBL has, the robo claimer, do they understand that UKPC use them as a public convenience just like they used and abused CST Law in Scotland

    UKPC will pick up on foolish legals and use them but UKPC has never had the guts to bring a court claim in their own name.

    Are DCBL really that

    You don't request a request!  You submit a request.  You are requesting all data held about you etc.  Don't offer them any excuses to delay the matter by offering "any more data to confirm" etc. I wouldn't use supplication, just simply you are "requesting all data held"
  • OK. Thanks for everyone replies. UKPC has responded. They have only sent photos, copy of PCN, notice to keeper and Appeal Correspondence. They have also stated that "Please note, there is a further charge against this VRM which was cancelled and all personal data has been redacted in line with UKPC’s retention policy.

    Of course they would never provide data that shows them cancelling a PCN issued for the exact same reason. They have also not provided "recorded telephone calls" as that would also expose them as their response was that they dont know why they cancelled one but not all.

    Push them on that, tell them that it's important to your case and you are entitled to the recording. Failure to provide it will result in a formal complaint to the ICO. Give them 7 days to supply it. 

    Try to push them more at any opportunity to try to extract a cancellation.

    Yep will do. They say they have also deleted the data on the PCN that was cancelled. Im guessing that I should also pursue that aswell? The cancelled PCN was given for the same reason as the current standing PCN's, so if one was to be cancelled, why not these but of course providing that data would expose their little lies. Thanks
