Success with Horizon Parking PCN - Tesco Bridlington

Just wanted to record thanks to Coupon-mad and reinforce with other newbies that the templates work!

Received a PCN from Horizon for overstaying the time limit at Bridlington Tesco (I'd left my electric car on charge overnight). However, as is reported elsewhere, Horizon cannot even be bothered to make their standard-issue Notice to Keeper compliant with POFA 2012. So the NTK did arrive within the correct timescale, but as it was not technically valid, I sent the Template "One Size Fits All" First Appeal, word-for-word and completely unaltered. Four weeks later, the PCN was withdrawn.

I had gathered back-up evidence for the POPLA appeal if we'd got to that (signage in the car park is non-compliant to the POPLA Code of Practice, plus the EV charging point that I was using had signs obviously put in place by Tesco that actually contradicted the Horizon signs), but I am very pleased to say that it was not needed because I guess Horizon are fully aware that they are not complying with POFA 2012 and so did not even attempt to dismiss the response. It just shows how spineless they are when they can't even be bothered to correct their own shortcomings and just continue to rely on scaring/bullying people into paying these outrageous PCNs.

    Why Tesco use them beggars belief, how much business are Tesco losing because of a scammer ?

    I actually don't know anyone, including myself who use Tesco as they hate their customers

    Firstly, if this was £70 discounted to £20 or £30 can you please show us a redacted copy of the NTK?  I want to show Government that PPCs are still accepting discounted PCNs around £25. I need pictures as evidence.

    I remember years ago parking in Stevenage Tesco.  This was about 2011. I parked there for most of the day for 2 days on the trot whilst I was working nearby. I knew someone in management there who said it was OK (little did I know forgot to white list me). Anyhow I got a letter through the door saying they appreciated my custom, but if I continued to park there again exceeding the limit then I'd get a PCN next time they write to me!  This was truly noted and understood and I didn't breach the rules (which I was unaware of) again. Thus was a refreshing approach. Can't remember what firm it was or if was Tesco themselves back then?!  They since turned over their land to ex-clampers.

    Ok, have bookmarked and will respond when it comes.

    You'll probably hear from me again when I go to court with another parking company where I failed to use the template in the first appeal (because at that stage I had not yet discovered this forum) and missed the POPLA appeal deadline (because I mistakenly assumed that the deadline would be extended during the Covid first lockdown, as was the case with just about every other "legal" deadline in the country). I've had the Letter Before Claim and I'm now waiting for the court summons, if it ever comes!

    Have you sent the "holding pattern" (debt advice) response to the LBC re. that other case? Have you sent a SAR to the PPC?

    Thanks for asking Jenni_D, genuinely appreciate your concern.

    I am now a complete convert to all of the info/advice/support on the forum here, so (after a quick check on the acronyms section contained in the newbies thread to ensure that I am answering this correctly), I did send the holding pattern response to the LBC, and got an acknowledgement - that was last October, but nothing since. I also sent an SAR to the PPC, and got a response from their data controller, who from the tone I suspect was rather fed up of answering this sort of request. I also put in an SAR to both of the dodgy/fake debt recovery "companies" and both "appointed solicitors" that I have received letters from over the past 2+ years, receiving replies from one of each. Note also that the one organisation that I spoke to a couple of times (one of the debt recovery companies; don't judge me, it was before I had found the forum and did not know to ignore them at that stage) has not provided any voice recordings, despite their system stating that all calls were recorded. Perhaps they're embarrassed by the person on the other end of the line who, in July 2020, said that they were unaware of Covid!

    With regards to being too late to make a PoPLA appeal, have a look at what the Alternate Dispute Resolution for Consumer Disputes that say ADR should be offered for not less than twelve months. I believe the twelve months begins from when the internal complaints/appeal process ends between the company and customer has been exhausted.

    The Alternative Dispute Resolution for Consumer Disputes (Competent Authorities and Information) Regulations 2015 (legislation.gov.uk)


    You should point out that the new mandatory appeals process that is due to come into force next year complies with the ADR Regs. It is therefore the government's intent that parking companies must operate in a fair manner and comply with existing regulations which at the moment they do not do. 

    By not allowing you to appeal to PoPLA after an arbitrary 28 day period, you were denied your rights to ADR according to current legislation.

    Thanks for this Horizon NTK and cover letter.  Really useful.

    You should use it as evidence to the Public Consultation, that this is evidence that discounting a parking charge for supermarket overstay to £30 proves that the proposed new level of £50 discounted to £25 easily and more than covers the minor costs (and profit per PCN) needed to make a cheap ANPR set up viable.
