CCJ for parking fine which I paid.

    That's not what we mean.

    We mean, look, they advertise free parking 'all day every day'.  The charge should have been disputed.  No-one here would have paid £60.  Never mind...that's history.

    But back to to case in hand. If you copied my email you gave them 14 days to respond.  So they have another week. You sent it to the right email? You attached proof of paying the £60?

    If no fair response, then crack on with a set aside and state you want ALL your costs and intend to counterclaim.

    Another tactic...how about sending a LBC for £600 to the MetroCentre who are responsible for the actions of their agent? Same legal arguments and rationale for you to claim compensation as I mentioned before.

    That might focus the PPC's mind if you send a LBC to the Metrocentre with the whole sorry story and hold THEM liable.

    Yeah I did dispute the charge originally and it went up to £150. I emailed the Metrocentre and they got it back down to £60 for me. I have the correspondence with the Metrocentre and have forwarded that to QDR solicitors along with a screenshot of my Monzo bank where I sent the £60 from. It even has the payment reference as my parking charge reference number.

    I know a lot in here wouldn't have paid it but I've spent a lot of time trying to repair my credit file from when I was broke so I figured I'd just pay the £60 and forget about it. Lot of good that did me! :o

    I emailed the Metrocentre and they got it back down to £60 for me. 
    That wasn't a good thing - it was terrible - and you were not risking your credit rating by not paying it.

    But now you can get your own back.

    Well tomorrow I have to start the process of taking them to court. Hoped it wouldn't come to this but I'm going to go ahead. The judge surely won't look too favourably on them ignoring me for two weeks as I tried to resolve this.

    If the actual CCJ is dated 14th June, you need to think carefully before you get THEM to sort this mess.

    Either:

    (a)  initially (bear with me) pay it immediately and it will be wiped, as long as you do this within a month of judgment. So you have 3 days. Don't leave it unpaid even though it's wrong...otherwise you have damage to your credit rating.

    or

    (b) if you are adamant not to do that now, you will suffer a massive plummet in your credit rating for a few months until this is sorted.

    Either way, email the PPC and their solicitors tomorrow and briefly tell them the story, that this was paid at £60 and attach proof that the shopping centre arranged that.  Therefore why the heck have they unreasonably filed a claim now?  Insist they sort it this month.  

    If you choose (a) above, then you'll be telling them you require all your money back and compensation for the distress, so will accept £300 by 31st July and will draw a line under it, except you will be reporting them to the ICO and to the shopping centre landowner client.

    If you choose (b) above, tell them the background and that they have ruined your credit rating and you will be suing them for, say, £600 (more? Four figures?) for damages, unless they pay the necessary £108 fee and they must apologise and handle the application and order needed to get this rogue CCJ set aside this month. You will also be reporting them to the ICO and to the shopping centre landowner client.

    Hi was going down the route of B.

    They've ignored two of my emails in the fourteen days which I gave them. I wasn't holding much hope of a reply. Obviously time is of the essance here with the 30 days almost up.

    I spent forty minutes on hold to them this afternoon waiting to speak to someone before I gave up and started filling out the N244 myself.

    In hindsight, and now I've finished work and had time to think about it more carefully I think I'm going to change to the route of A. I should probably have given them seven days rather than fourteen to reply which would have allowed me a little more room for manouvering but I'm confident that the judge will still side with me so A is probably the best route to avoid months of crappy credit rating.

    OK, neither suggestion required you to fill in a N244 unless they won't play ball.

    This is the thing. They are not even contactable to ask them to play ball. Emails ignored, phonecalls not answered. I've been on the phone for another half hour (and counting) and still can't get through to them to pay the bloody thing or even ask them !!!!!! they are doing. They are impossible to contact.

    Payment of £289 paid via their website. I'm beyond livid right now.

    Have emailed them the following:

    Hello

    I'm disgusted at the way your firm has treated me regarding this case. I've not heard from you in fourteen days. I can't get through to you on the phone. 40mins waiting yesterday and combined 45 mins today and counting as I'm still waiting in your queue.

    I'm going to pay the CCJ off today for the full amount and then I'm going to take you to court to claim it back and compensation for time spent on this and severe distress.

    I repeat, me paying this CCJ off today is NOT an acceptance that I owe the money. Its solely to make sure it does not stay on my credit report for six years.

    Sincerely"

    Small claims court for this case now I guess?
