Most important of all, you need something in writing from the insurance company to show when your partner was added as a named driver, and add it as an exhibit.
I agree with Le_Kirk that you need to be careful how you explain why you didn't buy another ticket.
The vicissitude was losing a contact lens.
Your priority was trying to find the lens and when that failed, you had the choice of buying another ticket or finding a way of leaving as soon as was legally possible. Even if you had bought another ticket, you would still not have legally been able to leave.
In order to attend to this vicissitude, you needed to add your partner to your insurance cover. You needed help to use the 'phone because you couldn't see to operate the buttons, you both needed to talk to the insurance agent to give details, and you couldn't do this and buy another ticket at the same time.

Hi all,
I already sent this off yesterday and this was the deadline and didn't receive any notifications from this forum! I suppose I will just have to go with what has been submitted.I have received the claimants WS today and in their response they have noted the incorrect name and address and date
"as there was no further physical or electronic ticket nor electronic permit in place for the defendants veichile between the times of entry ans exit of 30 May 2021, my company applied to the Driver and licensing agency (the DVLA) for the details of the registered keeper through the Keeper of a vehichle at the date of event ('KADOE') agreement: the application was made on 23 August 2021 with the DVLA responding on 24 August 2020 stating 'XXXXXX XXXXXX" (the dependant) was the registered keeper and the veichle was registered to the address of 'X XXXXX, XXXXXX, XXXXX"
ok so ...
30-05-21 - CORRECT DATE
23-08-21 - INCORRECT DATE (as PCN 07/06/21 so details would have been requested from DVLA before this date)
and the name of the "defendant" is not me and it is also Not my address. Surely they have breached GDPR here? They have clearly just copied and pasted an old WS from a similar case at the same car park?!
any advice appreciated0 -
Also I did see Le_Kirk advice prior to submission so I did amend based on the advice. I just didn't see your post @Fruitcake0

See what others say, but I suggest you save the discrepancies you mention above for the hearing then bring them up as a preliminary matter before the hearing itself starts if possible.
If not, then bring it up as soon as it is your turn to speak.
They may well have breached the DPA/GDPR, but not with your data. I suggest you contact the other party, if possible, to tell them what has happened, but not until after your hearing.
You don't want to warn them what has happened until it is too late for them to do anything about it.

Thank you.
One of my friends is a trainee solicitor and has suggested writing to them outlining all of things wrong with the statement and request the notice of discontinuance by 4PM son Tuesday. Not sure what to do - The most part of me is to just bring this to the hearing.0 -

I doubt a trainee solicitor knows more about the unregulated parking industry than the regulars on here.Mollyc977 said:Thank you.

My opinion is that if you bring the errors to the claimant's attention, they may have time to correct it. Personally, I would not bring it up until the hearing.I married my cousin. I had to...I don't have a sister.

Thank you both - I will follow the advice from here. Fingers crossed this (their errors) works in my favour.
Also a lot more discrepancies in their WS relating the dates / times (presumably based on this other persons case) and also they stated how I have used certain acts to back up my case and they are no longer in the use (not correct again based on my defence).1 -
One of my friends is a trainee solicitor and has suggested writing to them outlining all of things wrong with the statement and request the notice of discontinuance by 4PM son Tuesday.Standard training period for a solicitor is two years. The regulars here have been working on fighting private parking charges for at least five times (some six and seven times) that duration and concentrating only on private parking, no conveyancing, divorce, custody of children, boundary disputes, probate, etc to get our heads around, just pure and simple private parking. Most of us spend more time doing this on a daily basis than a solicitor will work in his office each day.I will follow the advice from hereSpot on, you're in good hands. No miracles promised, neither would a solicitor, but you won't be getting an invoice from us at the end of the saga! 😄Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Thanks all! Really appreciate it.The plan is to try and mention this when I'm first in the court (just not sure who to talk to?). If not I will mention as soon as the hearing starts.0
