Hi everyone,
I have a date for my case in court and need to submit evidence, however, I am not disputing poor signage etc. I have looked on the NEWBIES thread for advice but think my case differs from a lot of others.
It advised that if the claimant did not pay the court fees by a certain date then the claim would be struck out - would I be notified by this by mail?
Any help with this would be greatly appreciated as I'm feeling so anxious about the whole situation.0 -
You must dispute the signage. I refer you back to my earlier post where I showed you this image which needs to be included as an exhibit in your WS.

It is impossible to read the Ts and Cs from a moving vehicle, and in any case your main point will be frustration of contract, and the judge's comments in the Jopson vs Homeguard where he said attending to a vicissitude of some small duration is not parking.
I would suggest searching for a lost contact lens and not being able to drive would certainly constitute a vicissitude of some small duration.
Even if you didn't mention the Jopson case in your defence, the Consumer Rights Act 2015 section 71 comes into play. This deals with fairness, and it would be unfair to penalise someone who was unable to drive due to unforeseen circumstances. Did your defence not reference poor signage? I thought that it did, and if so you can still use the advice from @Fruitcake above.The pen is mightier than the sword ..... and I have many pens.1

Would the photographs from google suffice, or would you suggest going to take some myself? I actually live around 150 miles from the car park.Again thank you.0

If you Google 'Lligwy beach parking signs' and click on 'Images' you can find a variety of signs from the car park. Email the court where the case is being heard and the claimant and yourself. This is explained in the 12-step guide from the template defence thread and in the guide to court from the NEWBIES.
