    Payments have been cleared , but one is assuming they still want me out , so once it goes to court and it goes through 'that' process, thatll be when I move out (as that duration will give me time to find somewhere else). My guess is I would have up to December, so five months , since as the notice was invalid as well.

    How do I rebut this email informing them I will be looking to stay on exactly? I was actually looking to inform them around 22-23rd August, but since as this email has come through now, I guess I need to tell them now.....?


    (I have also received a 'checking out' email informing me they will be coming on 24th August to aid in the check out process as well)
    Dear Mr agent,
    As I am not ending the teancy on the 24th Aug there is no requirement for either re-marketing photography or a check out ispection at this time. Kindly cancel these appointments which are not approved.

    They have now 'started court proceedings' - I am going to assume this in itself will take 2-4 months...?

    When I receive court papers/have to go to court and I bring up the S21 was invalid, at what point/stance would it revert back?

    And if the judge agrees its invalid and reverts back the whole process, they reissue the s21 which is 2 months notice, I can still technically stay in the property, carry on paying rent and then at the end of the 2 months they would have to start court proceedings again?

    No, no they haven't (unless you're 2 months in arrears which you say you aren't, and anyway, they haven't issued an S8)

    As per the S21, they can't apply to the courts to get the property back until it expires. It says so on the legal document you have.

    They're trying to scare you. From now on, tell them you will only deal with them in writing.
    Take screenshots of all the threatening emails and tag them in all over Facebook.

    The assumption is that they are professional and know the law inside out, so if they send something it must be correct.
    If you have little knowledge of a certain matter then you tend to accept what you're told as correct.

    I received an 'accelerated possession' within the last two days now. (So I guess from the last post till now they were waiting/applying to the courts).

    I have read through all the paperwork and I cannot see any arguments from the agency/landlord as to why they want me out. (Upon researching on the internet, it can be because 'I didn't move out on the date of the section 21 , so now they requested the accelerated possession').

    Nevertheless, I have filled out my defence, i.e. s21 being invalid and I will be sending this off to the courts this week.


    (It is interesting though that in these 5 months I have been paying the rent, yet they still want me out... I would have thought they would have seen I've been paying so just let him carry on living there.... but hey.)

    Hardly surprising! You moved in and then didn't pay your rent so in their eyes you are not the sort of tenant they want and there's no reason why you wouldn't do the same again.
    There are literally millions of renters who have never missed a rent payment in their life so they'll be hoping the next tenant is one of those.

    The Bank of England has raised interest rates eight times since December 2021 as it continues to battle soaring inflation. The latest increase was by 0.75 percentage points taking the rate to 3% – a level not seen since 2008.
    On the 15th of June the BOE raised the base rate to 1.25% and now it's 3%
    For many landlords and owner occupiers this has Doubled the Interest they are paying.
