PARKING COMPANY UNABLE TO PROVE PCN DELIVERY DATE WITH NO STAMP-DATE ON ENVELOPE ?

    Sorry to hijack this post but can’t see a way to make a new one and this is close to my problem.
    received PCN from NCP today which falls way outside the 14 day rule. In fact 28 days to the day!
    charge is for not paying correct amount although there is a witness to say machine not working correctly and never gave the option to pick duration just a set amount.
    responded without admitting ownership or driver or machine fault but just pointing out the failure to comply with legislation on notification
    Sound OK?

    The parking company has up to six months to request keeper's details from the DVLA and their trade association allows them another month to send a Notice to Keeper to the keeper.

    You really must start a new thread if you want further help with your issue. Continuing here will only lead to confusion. I see that you have started new threads previously.

    Are the PPC legally obliged to follow this instruction from the retailer?
    No.

     only ask because if I still have to appeal then I have to prepare and submit it by tomorrow midnight.
    First appeal stage? Just do it and state that the retailer has confirmed they require the PCN cancelled.

    Don't use the word 'waiver' - wrong word! That's not what it means.
    Ok thanks......Do you mean just submit the retailers request to cancel, or actually submit my whole intended appeal and also  state that the retailer has confirmed they require the PCN cancelled.

    Use the standard appeal, then tack on to the end of it the bit about the retailer cancellation. 

    Just as a point of interest (I haven't read back through the thread, so apologies if already covered), is the car park one exclusive to the retailer, or one that serves a number of other outlets?

    Just the retailer i think although the carpark is split into two sites....
    PS:....Would like to upload the PNC and my appeal but cant find the attachment/upload icon.....any help appreciated.

    We don't need to see the PCN.

    You can't upload here and we do not need to see a template appeal with a simple line added that we've already advised you on.  That would be repeating what we've already said. This is easy and is going to be cancelled anyway.

    It's not a template... I have used large parts of the suggested template but have needed to  adjust some sections to make it relevant to my case.
    Which parts exactly are you concerned about and I will adjust accordingly.
